Dear Sir/Madam,
With reference to the above application I am to inform you that the information
submitted is not adequate to enable a decision to be made.
In accordance with the provisions of Article 33 of the Planning and Development
Regulations 2001 (as amended) you are hereby requested to submit further information
as set out on the attached page.
Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2)

requirement for further information, or such additional period, not exceeding 3 months,
as may be agreed by the Planning Authority, the planning application shall be declared
to be withdrawn”.
It should be noted that you will be required to give notice in an approved newspaper
under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the
Planning and Development Regulations 2001 (as amended) if the further information
received is considered to contain significant additional data.

ADDITIONAL INFORMATION
Note: Your assigned agent shall liaise with Planning Section prior to the preparation and submission
of this Further Information.
The submission should take a coherent account of any issues that overlap/interlink.
Should the Further Information materially/significantly alter the proposed development, you are
obliged to re-advertise same in accordance with Article 35 of the Planning and Development
Regulations 2001 (as amended).
1. On investigation, the conversion of the house into apartments would not appear to be
covered by a grant of planning permission. It is reasonably considered that your
development description should not/cannot refer to same. In addition, the house is not
within the curtilage of a protected structure.
Accordingly, as significant further information under Article 35 of the Planning and
Development Regulations 2001 (as amended), please (re)advertise the development
correctly, and submit copies of the site and press notices.
2. In the interests of clarity and appropriate design, please submit a concise report (separate
from the drawings) that details clearly, unit-by-unit, how the development proposal
acceptably complies with the relevant standards set out in the Departmental publication
Sustainable Urban Housing: Design Standards for New Apartments 2023.
Points of note in this regard include floor space for living areas, bedroom floor areas and
widths, storage space requirements (not including hot presses, boiler spaces, etc), private
amenity space provision, and natural lighting.
As a building refurbishment scheme, any relaxation of the requirements must be framed in
the context of overall design quality, i.e. demonstrate why the overall design quality would
merit a relaxation of the requirement(s).
3. Policy RDP 24 of the County Development Plan 2019-2025 states that development which
has the potential to detrimentally impact on the residential amenity of properties in the
vicinity shall be resisted.
The site is surrounded by existing housing. As per the info submitted, it is unconfirmed if the
(re)development would detrimentally impact on the residential amenity of the adjacent
properties.
Accordingly, please submit further and/or revised details confirming why and how your
development would not impact negatively on the residential amenity of the adjacent
properties.
4. As per Section 15.12 of the County Development Plan 2019-2025 and Sections 4.8 and 4.9 of
the Departmental publication Sustainable Urban Housing: Design Standards for New
Apartments 2023, it is unconfirmed that suitable provision has been made for refuse/waste
storage.
Accordingly, please submit further and/or revised details that demonstrate how provision
has acceptably been made for waste storage. Communal bin storage facilities (satisfying the
three-bin system for the collection of mixed dry recyclables, organic waste and residual
waste) should be suitably provided in a well-ventilated space convenient to the apartments,
both in terms of deposit and collection.
5. Policy LCP 1 of the County Development Plan 2019-2025 requires all planning applications to
include a comprehensive (hard and soft) landscaping plan commensurate to the scale of
development on-site.
Accordingly, please submit a compliant landscaping plan clearly confirming the nature and
extent of all (i) site and curtilage boundary treatments, and (ii) hard and soft surfacing.
6. In the interests of clarity and appropriate design, and to allow for fully informed decision,
please submit a Quality Audit for the proposed development, which is to the satisfaction of
Road Design Section – see Section 5.4.2 of the latest version of the Design Manual for Urban
Roads and Streets (DMURS), available at www.dmurs.ie.
7. In the interests of clarity and appropriate design, please submit a commensurate public
lighting plan/design for the site, which accords with the pertaining British and European
Standards and is to the satisfaction of Road Design Section (specifically, the technician
responsible for public lighting).
8. The information submitted is insufficient with regards environmental protection.
Accordingly, please submit:
(a) A completed Water Protection Plan checklist.
(b) A commensurate site drainage proposal to include an adequately sized and suitable
Class 1 Interceptor(s) to treat surface water arising in carpark area prior to discharge
from the site.
(c) A revised site drainage plan (1:500) demonstrating the following:
(i) Existing and proposed surface water drainage systems (outlined in blue).
(ii) Existing and proposed foul water drainage systems (outlined in red).
(iii) All associated discharge points and outfalls.
(iv) Demonstrate proposed location for the adequately sized Class 1
Interceptor(s) and location of outfall(s).
9. In the interest of clarity and to allow for a fully informed decision, please submit suitable
confirmation that you are civilly entitled to access and use the lane/entry to the rear of the
site (where apartment 5 would be accessed from).
10. An objection to your application has been received. Points raised relate to appropriate
design, undue impact on residential amenities, rights of way, and car parking. Please review
the planning file and respond to the issues raised therein.
