Re: Planning and Development Act 2000 (as amended).
Planning and Development Regulations 2001 (as amended).
25/60371 - planning permission to carry out works to the curtilage & site area of same. Said church
is listed within the Record of Protected Structures within the current Monaghan County
Development Plan, Ref. No. 41401809 & is also listed within the National Inventory of Architectural
Heritage (NIAH) with ‘Regional’ rating & Ref. No. 41401826 The works shall include: a) Demolition
of former school building to Northern side of site. b) Creation of new vehicular site entrance from
public road to Northern Boundary, which includes the partial removal of boundary wall. c) Creation
of vehicular access route from said new entrance, to perimeter hard standing area of church
building. d) Conversion & adaption of existing tennis court area to lined-out car parking, with
additional disabled parking provided to south of church building. e) Re-grading of perimeter
driveway / hard standing area to church building, to include low level perimeter railing, drainage
works & tar-and-chip type surfacing. f) Replastering & repair of entrance piers to West of site. All
along with other associated ancillary site works at Derryvally Ballybay Co. Monaghan.

Dear Sir/Madam,
With reference to the above application, I am to inform you that the information submitted is not
adequate to enable a decision to be made.
In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001
(as amended) you are hereby requested to submit further information as set out on the attached
page.
Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification)
is not complied with within the period of 6 months from the date of the requirement for further
information, or such additional period, not exceeding 3 months, as may be agreed by the Planning
Authority, the planning application shall be declared to be withdrawn”.
It should be noted that you will be required to give notice in an approved newspaper under article
35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development
Regulations 2001 (as amended) if the further information received is considered to contain
significant additional data.

Different Information, 6 copies of additional information to be submitted.

ADDITIONAL INFORMATION
1. The First Ballybay Presbyterian Church is designated as a protected structure under the provisions
of the Monaghan County Development Plan 2025-2031. The demolition of the former school house,
a prominent building within the curtilage of the church and a building understood to have been built
at a similar time to the church, would result in a significant loss of historic fabric associated with this
building of National Importance. Similarly, the removal of a stretch of boundary wall to facilitate a
new entrance would result in a significant loss of historic fabric to the setting of the church building.
To permit the demolition of the former school building and boundary wall would be contrary to the
provisions of policies BHP1-BHP5 of the Monaghan County Development Plan 2025-2031. The
submitted Architectural Heritage Impact Statement fails to adequately justify the demolition of the
former school house or the removal of a portion of the curtilage wall. Consequently, the applicant
is requested to submit revised proposals which do not involve the demolition of the former school
building and the removal of the curtilage wall.
2. It is considered that the proposal to create a six metre wide access road within the grounds of the
protected structure would have an adverse impact upon the visual amenity of the grounds of the
church and upon the setting of the church itself. The applicant is requested to submit revised
proposals which are visually in keeping with the grounds and setting of the protected church.
