Re: 2560415 Dermot Mooney
Consultants: Peter Culleton
Permission: Permission will consist of the re-contouring of existing undulating
agricultural farmland to include the importation of soil, subsoil and inert material in order to
raise the levels of part of the land together with all ancillary site development works. The
lands will be recovered with topsoil and reseeded with ryegrass upon completion of the re-
contouring works.
Location: Binmore, Lough Egish Co. Monaghan.
Date: 256/11/2025
The planning application site is located in located in the Major Lough Stream 010 sub
catchment . The ecological status of the is waterbody is poor, and is at risk of not meeting its
Water Framework Directive Targets by 2027. The groundwater vunerability is extreme but
the underlying aquifer is poorly productive.
The application lacks detail. No details on authorisation type has been submitted with this
development. It is not clear if the applicant intends to import material via Article 27, a
certificate of Registration or a Waste Facility Permit. A topographical Survey will be required
in order to determine area to be infilled and allowable tonnages. Inert waste cannot be used
as fill under Article 27.The level of fill to be imported onto the site is not clear. It is therefor
not apparent if appropriate assessment screening is required for this development. The
scale of the development had not been detailed.
Recommendations
The following additional information is required from the applicant:
a. The applicant shall clarify if this development will be filled by Article 27
National By Product declaration for greenfield soil and stone or by application
for facility authorised under S.I. No. 821/2007 - Waste Management (Facility
Permit and Registration) Regulations 2007
b. If a waste authorisation is required the applicant shall :
1) provide clarification on the classes of activity requested in accordance with
the Third Schedule Part II of the Waste Management (Facility Permit and
Registration) Regulations 2007 as amended.
2) Identify surface water drainage ditches onsite and in close proximity to the
site, including dry drainage ditches that have the potential to hold surface
water
3) Demonstrate an adequate buffer zone from drainage ditches identified on
the development site and surrounding lands
4) The applicant shall demonstrate on the revised site layout plan the location
of the wheel wash structure (if applicable as per point c.) and a waste
quarantine area onsite
c. If Article 27 consent is required the applicant to:
1) Identify surface water drainage ditches onsite and in close proximity to the
site, including dry drainage ditches that have the potential to hold surface
water
2) Demonstrate an adequate buffer zone from drainage ditches identified on
the development site and surrounding lands
d. The applicant shall have the following assessment completed by a qualified
Environmental Consultant and a report submitted demonstrating the
following:
1) Demonstrate the suitability of the proposed development site for the
importation of the proposed waste material. This shall include an
assessment on the impact this development and the proposed waste type
will have on groundwater and surface water and air, including
identification of potential pathways to groundwater and surface water and
any nearby drinking water supply sources and wells and identify proposed
mitigation measures to protect groundwater and surface water from
activities associated with this development.
e. The applicant shall submit a revised tonnage of waste or greenfield soil and
stone material proposed to be imported and infilled onsite taking into account
a reduced infill area onsite as a result of buffer zones. This to include a
topographical survey using ARC 3D or similar modelling.
f. The applicant shall submit an agricultural improvement plan demonstrating no
net loss to biodiversity or water quality following completion of infilling.
