25/60416 - permission and permission for retention consisting of the following: A change of use of
1 bay of existing machinery shed to proposed waste processing building, erect new Bio Filter
Structure to side of building, new structure over existing wastewater tanks concrete apron and all
ancillary works. To retain existing storage shed and underground tanks and office buildings and all
associated site development works. A waste facility permit and/or certificate of Registration
application will be applied for separately to Monaghan County Council at Mullanarry Carrickmacross
Co. Monaghan.

Dear Sir/Madam,
With reference to the above application, I am to inform you that the information submitted is not
adequate to enable a decision to be made.
In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001
(as amended) you are hereby requested to submit further information as set out on the attached
page.
Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification)
is not complied with within the period of 6 months from the date of the requirement for further
information, or such additional period, not exceeding 3 months, as may be agreed by the Planning
Authority, the planning application shall be declared to be withdrawn”.
It should be noted that you will be required to give notice in an approved newspaper under article
35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development
Regulations 2001 (as amended) if the further information received is considered to contain
significant additional data.

ADDITIONAL INFORMATION
1. Section 15.22.2 of the Monaghan County Development Plan 2025-2031 states that
‘development which has the potential to detrimentally impact on the residential amenity of
properties in the vicinity of the development, by reason of overshadowing, overbearing,
overlooking, dominance, emissions (e.g. noise, smell, pollution) or general disturbance, shall
be resisted’. Having regard to the nature of the application, the proximity of the site to
residential properties and the issues raised in the submitted objections, the applicant is
requested to provide the following;
a) A noise impact assessment taking into account background existing noise
levels and proposed increase in such levels as a result of the proposed
development.
b) An odour assessment which takes into account EPA Air Guidance Note (AG5).
The applicant should note that Section 4.4.1 of the submitted Odour
Management Plan incorrectly refers to the surrounding environment as
‘predominantly agricultural’ and that Appendix A (site boundary odour
monitoring locations), as referenced under Section 4.4.1, has not been
included within the submitted documentation.
c) An air dispersion model, taking account of EPA ‘Air Dispersion Modelling’
Guidance note AG4.
d) The applicant should note that items b) and c) above shall take account of
background odour air dispersion within the surrounding environment and
nearby sensitive receptors.
2. The Planning Authority considers that insufficient has been provided with regard to proposed
waste processing operations that are to be carried out at the site. The applicant is therefore
requested to provide the following details;
a) A detailed description of the waste screening process, the biofilter technology
to be used and the process involved.
b) Details of the exact volumes of waste to be stored on site at any one time. This
shall include the maximum volume the storage facilities can hold.
c) Details of proposed hours of operation.
3. The proposal is considered insufficient in terms of site drainage details. The applicant is
therefore requested to submit a revised site layout drawing (1:500 scale) showing details all
foul and surface water infrastructure and associated outfalls. All gullies and manholes to be
clearly marked.
4. a) Planning Authority notes that the submitted office plans (Dwg No.3.3_P1-03)
do not accurately reflect the building to be retained in terms of height, roof
pitch and detailing. The applicant is therefore requested to provide amended,
accurate plans for consideration.
b) Planning Authority notes the proposed development description refers to the
retention of a storage building however, it is unclear from the submitted
layout plan as to which building this is referring to. It is also unclear as to how
the existing rectangular building/structure, highlighted in blue and located
west of the existing machinery shed, is to be used. In the interests of clarity,
the applicant is requested to submit a revised layout plan clearly
highlighting/describing (i) those buildings which are to be retained as part of
this application (ii) those buildings which are proposed as part of this
application (iii) any existing authorised buildings which that do not from part
of this proposal. The applicant should ensure that the description of the
development is clear and unambiguous in this regard and that it corresponds
with the submitted drawing details.
5. a) The Planning Authority considers that insufficient detail has been provided
with regard to proposed vehicle parking and manoeuvring within the site. The
applicant is therefore requested to submit a revised layout plan clearly
demonstrating how adequate parking and manoeuvring areas will be provided
for any vehicles (cars, lorries, tankers etc) that will be attracted to the site. The
details provided should be demonstrate compliance with Section 15.24, Table
15.5 ‘Car Parking Standards’ and Policy CP 1 of the Monaghan County
Development Plan 2025-2031. Details of existing/proposed surface treatments
for proposed parking areas and the entire site should also be provided.
6. The Planning Authority notes that the site is served by a second entrance the northeast corner,
which facilitates entry/exit to and from the site. The submitted layout plan shows this access
to be blocked up with proposed landscaping/boundary treatment. The applicant is requested
to clarify future intentions with regard to this exit/entrance and confirm if it is intended to be
used to serve the development/use on site. Where the applicant seeks to use this
entrance/exit, this should be reflected in the submitted plans and the development
description.
7. Planning Authority notes that no details of flood lighting or security lighting have been
provided with the submitted application. Section 8.39 ‘Lighting’ and associated policies LP 1, 2
and 3 of the Monaghan County Development Plan 2025-2031, seek to prevent light pollution
in the interests of nature conservation, residential amenity and energy efficiency. In order to
control lighting and minimise impacts on residential amenity, the applicant is required to
submit details of existing and/or proposed lighting serving the proposed development in
accordance with aforementioned policies LP 1, 2 and 3.
8. The development description of the proposed development refers to change of use of one bay
of the existing machinery shed to proposed waste processing building. However, the plans
indicate that bays 1, 2, and 3 of this existing building are to be used for waste processing. The
applicant is required to submit clarification of this matter and amend the development
description accordingly to reflect the proposals on the submitted plans.
9. The Planning Authority has received several third-party submissions in respect of the proposed
development. The applicant is invited to review the content of same and provide a detailed
response to the issues raised.
Note: It is recommended that you and/or your assigned agent liaise with Monaghan County
council Environment/ Environmental Health/Planning Sections prior to the preparation and
submission of this Further Information.
Applicant to note the information required above will likely constitute significant additional
information. In accordance with Article 35 of the Planning and Development Regulations
(2001) as amended, a revised site notice shall be erected on site and shall be submitted to the
Planning Authority along with a revised published press notice indicating the revisions to the
application.
