25/60430 - permission for development which will consist of the importation of subsoil to raise and
level existing ground for improvement of existing agricultural field off new entrance onto shared
lane and include all associated site works. The class of activity will be; class 5, & 6 of the Third
Schedule Part 11 Waste Management (Facility Permit & Registration) Regulations, 2007 as amended
at Nafarty, Carrickmacross, Co. Monaghan..

Dear Sir/Madam,
With reference to the above application, I am to inform you that the information submitted is not
adequate to enable a decision to be made.
In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001
(as amended) you are hereby requested to submit further information as set out on the attached
page.
Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification)
is not complied with within the period of 6 months from the date of the requirement for further
information, or such additional period, not exceeding 3 months, as may be agreed by the Planning
Authority, the planning application shall be declared to be withdrawn”.
It should be noted that you will be required to give notice in an approved newspaper under article
35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development
Regulations 2001 (as amended) if the further information received is considered to contain
significant additional data.

ADDITIONAL INFORMATION
Note: You and/or your assigned agent should liaise with Planning Section prior to the preparation
and submission of this Further Information.
The submission should take a coherent account of any issues that overlap/interlink.
Should the Further Information materially/significantly alter the proposed development, you are
obliged to re-advertise same in accordance with Article 35 of the Planning and Development
Regulations 2001 (as amended).
This request does not imply that the proposal is acceptable in principle. The Planning Authority
reserves the right to refuse permission should the issues identified remain unresolved or if other
concerns arise.
1. Notwithstanding the information submitted, the Planning Authority remains concerned
regarding potential noise, odour, and general disturbance impacts associated with the
amount of infilling proposed upon the surrounding area.
Accordingly, please provide a Noise, Odour and General Disturbance Impact Assessment
specific to the site and the setting. The assessment shall evaluate likely operational impacts on
the nearest sensitive receptors and clearly demonstrate how any identified risks will be
acceptably managed. The report shall be prepared by a suitably qualified professional and
shall include:
(a) Details of all recommended mitigation measures for incorporation into the final
proposals / management of activities associated with the proposed infilling.
(b) Details for continuous noise monitoring during the operational phase, including what
steps would be taken if noise levels go above agreed limits.
(c) A community liaison plan, to inform nearby residents (and to keep them informed)
about the works and about who they could contact if issues arise.
2. The information submitted is insufficient with regards environmental protection and the
proper planning and sustainable development of the area. Accordingly, the following is
needed:
(a) The applicant shall provide clarification on the classes of activity requested in
accordance with the Third Schedule Part II of the Waste Management (Facility Permit
and Registration) Regulations 2007 (as amended). The applicant has stated that subsoil
(Class 5) will be imported onto the site. The applicant also states Class 6 activity;
however, Class 6 activity is for the importation of inert waste (other than excavations
or dredgings comprising natural materials of clay, silt, sand, gravel or stone).
Therefore, the applicant should clarify if the class of activity proposed for the
importation of waste will be Class 5 activity only and also provide the EWC code
proposed to imported.
(b) The applicant shall submit an assessment and a report completed by a qualified
Environmental Consultant demonstrating the suitability of the proposed development
site for the importation of the proposed waste material. This shall include an
assessment on the impact this development and the proposed waste type will have on
groundwater and surface water, including identification of potential pathways to
groundwater and surface water and any nearby drinking water supply sources and
wells and identify proposed mitigation measures to protect groundwater and surface
water from activities associated with this development.
(c) The applicant shall submit details of a suitable wheel wash structure or alternative
solution in order to keep the access roads clear of silt and debris.
(d) The applicant shall submit a revised site layout plan and site sections clearly
demonstrating:
(i) Surface water drainage ditches on-site and in close proximity to the site,
including dry drainage ditches that have the potential to hold surface water.
(ii) An adequate buffer zone from drainage ditches identified on the development
site and surrounding lands.
(iii) the location of the wheel wash structure and a waste quarantine area on-site.
(e) The applicant shall submit a revised tonnage of waste material proposed to be imported
and infilled on-site taking into account a reduced infill area on-site as a result of the
required buffer zones.
(f) The applicant shall submit an agricultural improvement plan demonstrating no net loss
to biodiversity or water quality.
3. The information submitted is insufficient with regards traffic safety and access standards.
Consequently, the following is needed:
(a) Submit a Traffic and Transport Assessment Scoping Study, prepared in consultation
with the Council’s Roads Section, to establish the appropriate scope and methodology
for any subsequent Traffic and Transport Assessment that may be required. The study
should address, inter alia:
(i) Existing traffic conditions and access arrangements.
(ii) Trip generation and distribution associated with the proposed development.
(iii) Potential impacts on the local, regional and national road network.
(iv) Proposed mitigation or improvement measures, where applicable.
The scoping report should be discussed and agreed with the Council’s Roads Section prior to
submission of any final Traffic and Transport Assessment.
(b) Submit a Stage 1/2 Road Safety Audit (RSA), together with the corresponding
designer’s response. The RSA shall be undertaken by an independent and approved
RSA Team and should address all relevant elements including:
(i) A revised site layout plan with access design and visibility splays.
(ii) Interaction with the public road network.
(iii) Any recommended mitigation measures.
The findings of the RSA and the designer’s response shall be agreed with the Council’s Roads
Section and the Carrickmacross Municipal District (MD) Engineer prior to finalisation.
(c) A Traffic Management Plan (TMP) addressing HGV routing, timing, signage, and
measures to minimise disruption to surrounding road users.
(d) Provide legal proof of the applicant’s right of way to allow access for the purposes
proposed.
4. In the interest of clarity and to allow for a fully informed decision, please confirm the intended
operating hours.
5. Section 15.32 of the County Development Plan 2025-2031 relates to the infilling of lands.
In the interest of clarity and to allow for a fully informed decision, please demonstrate how
the infilling, to improve the existing agricultural field, would meet current farm management
requirements.
6. It is noted that the cross sections do not accurately convey the details of infilling and levels
indicated on the submitted site layout. Applicant is required to submit a revised site layout and
cross sections which correlate in terms of:-
(a) existing site levels
(b) proposed site levels
(c) extent of infilling
