Monaghan. _______________________________________________________ Dear Sir/Madam, With reference to the above application, I am to inform you that the information submitted is not adequate to enable a decision to be made. In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001 (as amended) you are hereby requested to submit further information as set out on the attached page. Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification) is not complied with within the period of 6 months from the date of the requirement for further information, or such additional period, not exceeding 3 months, as may be agreed by the Planning Authority, the planning application shall be declared to be withdrawn”. It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Monaghan ADDITIONAL INFORMATION Note: A pre-application consultation did not take place; you and/or your assigned agent should liaise with Planning Section prior to the preparation and submission of this Further Information. The submission should take a coherent account of any issues that overlap/interlink. No inference is given in requesting this Further Information that planning permission will ultimately be forthcoming. 1. In accordance with Section 15.13 (Agricultural Development) of the County Development Plan 2025-2031, please submit detailed information to demonstrate the agricultural requirement for the proposed development. This should include: (a) Evidence of an active agricultural enterprise on the subject lands (e.g. herd number, Department of Agriculture registration, farm accounts, or other supporting documentation). (b) A clear justification for the size and design of the proposed shed, relative to the scale and nature of the farm operations. (c) Details confirming the intended use of the shed. (d) Confirmation that the proposed development would not be used for commercial or non-agricultural purposes. (e) A fully completed agricultural planning application form. 2. In the interest of clarity and to allow for a fully informed decision, please confirm whether the existing dwelling located immediately adjacent to the proposed development site (and shown outside the red line boundary on the submitted site layout plan) is within your ownership and control. This clarification is required in accordance with Section 15.13.1g of the County Development Plan 2025-2031, which seeks to ensure that agricultural development does not adversely impact the residential amenity of dwellings not in the applicant’s ownership. 3. In accordance with Section 15.13.1g of the County Development Plan 2025-2031, please submit written consent from the owner of the house to the southwest within 100m of your proposed development, stating that they have no objection to the proposal. Said written consent must be witnessed (i.e. also signed) by a solicitor or a peace commissioner. Additionally, same shall be supplemented with a corresponding 1:500 map that clearly identifies the mentioned house. 4. The information submitted is insufficient with regards traffic safety and access standards. Consequently, please submit the following: (a) A 1:500 site layout plan that accords with Section 15.23 of the County Development Plan 2025-2031, clearly illustrating visibility splays of 70m along the adjoining local road measured to the nearside road edge in each direction, provided from a point in the centre of the roadside entrance 2.4m from the road edge at a height of between 1.05m and 2m above ground level to an object height of 0.26m and 2m above ground level in both directions. (b) If applicable, legal agreements with adjoining landowners giving their consent to allow removal/trimming of their hedgerows, etc, to provide the required 70m sight distances, where said sight distances are not achievable within the site area and where hedgerows or other such impediments beyond the site do not belong to the applicant. The legal agreements shall be accompanied by an appropriate ordnance survey map that shall also be signed and witnessed by a solicitor. The planner dealing with this application is Ben Clerkin
