Planning and Development Regulations 2001 (as amended). 25/60458 - retention and permission for a development the proposed works will consist of the following: 1) To retain change of use from a single storey agricultural shed to a two-storey style dwelling house with carport and garage on ground floor level, with increased ridge height, elevational changes and retain entrance gate pillars with wing walls and concrete apron at roadside, and 2) Permission to complete the development and proposed new sewerage wastewater treatment system and percolation area, additional sunroom extension, raising of ground levels to the southwest side of the existing development, and all ancillary site works at Agheeshal Broomfield Co. Monaghan. _______________________________________________________ Dear Sir/Madam, With reference to the above application, I am to inform you that the information submitted is not adequate to enable a decision to be made. In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001 (as amended) you are hereby requested to submit further information as set out on the attached page. Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification) is not complied with within the period of 6 months from the date of the requirement for further information, or such additional period, not exceeding 3 months, as may be agreed by the Planning Authority, the planning application shall be declared to be withdrawn”. It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Please Note: 4 copies of Additional Information to be submitted. In the case of Significantly Different Information, 6 copies of additional information to be submitted. The applicant is therefore strongly advised to liaise directly with the Planning Section, following receipt of this Further Information request. 1. Following a site inspection, the Planning Authority notes that a large, cladded shed and associated concrete yard area, has been constructed to the rear of the proposed dwelling which, according to our records, does not have the benefit of planning permission. It is noted that this unauthorised structure is served by the same access/entrance as the proposed development, is located entirely within lands owned by the applicant and is partly located within the application site red line. It would be inappropriate for the Planning Authority to consider granting permission for the proposed development, given it is intrinsically linked to the aforementioned unauthorised development and it would facilitate the consolidation and intensification of same. The applicant is therefore requested to review the proposal as submitted and provide clarification with regard to this fundamental issue. 2. Criterion (g) of Section ‘15.22.4 Landscaping and Boundary Treatment’, of the Monaghan County Development Plan 2025-2031 stipulates that ‘Where removal of extensive hedgerow and trees is proposed, existing site boundaries shall be supplemented, where new site boundaries need to be created, or where landscape mounds are proposed, a costed landscape plan, prepared by a suitably qualified, competent, technical professional with landscaping expertise shall be submitted where appropriate. A bond may be applied in the event of a grant of permission to ensure the satisfactory completion of the landscaping.’ The Planning Authority notes the submission of a detailed landscaping plan, associated planting schedule and photomontages, as prepared by Landscape Design Services. Whilst the submitted details are considered commensurate to the scale of development proposed, it is noted that the proposed landscaping works have not been costed. Accordingly, and in order to ensure the proposal can comply with aforementioned Section ‘15.22.4 Landscaping and Boundary Treatment’ the applicant is requested to provide an accurate breakdown of costings associated with the submitted landscaping proposals. 3. Proposals for dwellings are required to comply with Section 15.9.2 ‘Site Selection and Design Guidelines’ and Table 15.3.3 ‘Guidelines for Siting and Designing a Rural House in the Vernacular Style’ of the Monaghan County Development Plan 2025-2031. Notwithstanding the submitted landscaping details and clarification requested under item 2 above, the Planning Authority has the following specific design concerns with the proposed development; (a) The proposed side extension (and the associated raised infilled area to facilitate same) is considered unacceptable due to its form, fenestration, overall appearance, and relationship with the main dwelling. (b) The proposed porch is disproportionate to the main dwelling and appears over- dominant and incongruous within this setting. The applicant is therefore requested to provide amended details/mitigating drawings to address the issues raised above. 4. Section 15.23.1 ‘Visibility Splays Agreement’ of the Monaghan County Development Plan 2025- 2031 states that ‘Proposals requiring works on third party land must be accompanied by a written legal agreement, in accordance with Appendix 13. This legal agreement and accompanying maps shall be signed by all parties and witnessed by a Solicitor’. A legal agreement has been submitted with the application however, it is noted that it has been signed by a Commissioner for Oaths, rather than a solicitor, as required under aforementioned section 15.23.1. The applicant is therefore requested to provide an updated and amended legal agreement with accompanying maps signed by all parties and witnessed by a Solicitor, in accordance with aforementioned section 15.23.1. 5. The Planning Authority notes that the submitted site layout plan/floor plans do not correspond with the submitted landscaping plan. in respect of the proposed single storey extension and the extent of the proposed driveway/concrete apron surrounding the dwelling. The applicant will be requested to provide amended drawings to address same. 6. The Planning Authority has received a third-party submission in respect of the proposed development. The applicant is invited to review the content of same and provide a detailed response to the issues raised. The planner dealing with this application is Brian McGeary
