LUCAS HORTON, 3 BRAMLEY HOUSE McGRATH ROAD, CASTLEBLAYNEY COUNTY MONAGHAN Neighbour Planning Report Application Nrs 2560514 and 2560497 dated 11112125 Jan 8th 2026 General Re Planning Ref 2560514 and 2560497 Ben Clerken, Planning Department, Monaghan County Council, 1 Dublin Street, Monaghan, Co Monaghan To whom it may concern I write on behalf of my client David Boyd, (this letter also signed by him) in relation to the above planning application. David Boyd lives in the adjacent property on the North side. We wish to register objections to the proposals on the following grounds. The site notice is dated 11/12/25 but it did not appear until 1/1/26. This has been confirmed by my client and another neighbour. The application involves land owned by my client. See attached land registry compliant map dated 13/08/2016 showing my clients lands. Also enclosed are confirmation by Monaghan County Council letter dated 06/Nov2017 photographic evidence of the subject site to be entered into the Derelict Site Register entry proposals. David Boyd has occupied the building including the rear garden since 1974. The proposed extension would have windows that directly look out onto my client's rear garden. The nature and size of the proposed extension would significantly overshadow my client's property and affect his privacy. The applicant's property has been in the ownership of the applicant for many years and the property has not been maintained and boundary issues with my client have not been attended to. This current application seems to be very similar to applications made in 2018 and in 2007. The process of making successive planning applications over the last 19 years is clearly only being made to avoid derelict site status, taxes and potential CPO proceedings. Documents enclosed Land Registry Compliant map prepared for David Boyd 13/08/2016 Derelict Sites Act Letter from Mary McGarvey accepting the attached drawing showing the site boundary of the application site. Letter of intent from Monaghan County Council re derelict site register with attached site boundary Photographs overlooking the derelict site from David Boyd's garden taken 02/10/2017. Copy of plans highlighting overlooking aspects of the proposal Extract from Monaghan County Plan showing Protected Status of local importance of the Lakeside Cottages. We are instructed that Lucas Horton architect has written independently on behalf of our client in relation to other Issues arising out of the Application. All objections should be read in conjunction with each other. I am attaching a map which is outlined in red which I understand represents the area being sought on foot of the above planning reference numbers to be developed. The position however is that the area hatched in blue belongs to our client and has been enjoyed by him and his predecessors In title since 1860 in possession. Unfortunately there is no map attached our client's deeds that can be furnished at this point however we can confirm that our client who is in his 90"' year was present at the auction when the applicant's husband purchased the property and it was specifically stated that our client's garden was not included resulting In the applicant's husband after acquiring the property ,erecting a wall preventing access to our client's garden and defining his boundary on the ground. We presume the wall was also built by him to prevent our client having access to the property the applicant's husband had just purchased. This wall was erected and there is no access to our client's garden since 1972 from the applicant's property. Our client has enjoyed this garden in possession as an Integral part of his own holding for the period outlined at the head of this letter by himself and his predecessors In title. Any application made to develop should not Include our client's garden and any application considered by the council should not entertain the applications lodged as It effectively claims ownership over our client's property to which the applicant does not and have or access from the date of purchase of the holding in 1972 and the subsequent physical erection of the wall blocking all access. There is no consent clearly by our client for any application to be made by the applicant over the area hatched blue on the map attached .
