It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Yours faithfully, __________________________ ADMINISTRATIVE OFFICER pp 25/60463 Ronan Boyd Binmore, Castleblaney, Co. Monaghan ADDITIONAL INFORMATION 1. The proposed development is of a type listed under Part 2 of Schedule 5 of the Planning and Development Regulations 2001 in that it is ‘an installation for the disposal of waste’. It is unclear however, from the application as submitted as to whether or not the development is subthreshold i.e. if the annual intake waste is greater than 25,000 tonnes. The Planning Authority note that this development proposes the importation of 55,880 tonnes of greenfield soil and stone to be infilled on site to raise ground levels between 1m and 3m across the site, although a timeline for infilling has not been provided. a) The applicant is required to provide clarification on this matter to enable a formal screening determination to be carried out for this development. Please note that if it is determined that an Environmental Impact Assessment Report is required to accompany this planning application, pursuant to Article 103(1) of the Planning and Development Regulations (2001) a notice shall be issued to the applicant in this regard. Note: As per Article 103(4) “the application shall be deemed to be made on the date of receipt by the Planning Authority of the EIS”. On this basis the ‘8-week period’ for determination of this application shall not commence as per Article 33 of the Regulations until receipt of an EIS relating to this application. b) In addition to providing clarification on the amount of waste to be filled annually in metric tonnes at this site, the applicant is also requested to provide a breakdown on the volume waste to be filled during each phase and how the associated tonnage of fill material for each phase will achieve the level of fill proposed, as shown on submitted site sections. 2. The Planning Authority note that the northern part of the site is within an area identified as ‘wetland indicating sediment’ according to Map of Irish Wetlands survey. Policy WLP1 of the Development Plan states that development that would destroy, fragment or degrade any wetland will be resisted. In addition, the Office of Public Works (OPW) Preliminary Flood Risk Assessment (PFRA) maps indicate that the northern end of the proposed site is vulnerable to pluvial flooding. It is advisable that this area of the site be kept free from any infilling and associated site works. Should infilling proposals remain for this part of the site then the applicant is advised as follows a) An Ecological Impact Assessment shall be submitted. b) In accordance with Policy ILP 1 and Section 15.32 of the Development Plan (‘Infilling of Lands’) a site-specific Flood Risk Assessment shall be submitted in accordance with Section 15.22.8 of Chapter 15 of this Development Plan. Any Flood Risk Assessment shall be completed by a competent professional with hydrological experience, confirming that the development: • will not be at risk of flooding • will not exacerbate flooding in the immediate vicinity or wider area. • will not obstruct or impede important flow paths • will not result in residual risks to the area and/or development that cannot be managed to an acceptable level. The flood risk assessment shall also clearly demonstrate proposed management of any residual risks. 3. The Applicant has submitted a Site Layout Plan indicates that the application site will be accessed of the Local Primary Road, however the layout plan does not include any detail on whether or not the required visibility splays can be achieved ta the entrance. In this regard, the applicant is requested to submit: a) A revised Site Layout Plan (1:500 scale) indicating how a clear and unobstructed visibility splays of 70m can be achieved at the proposed entry/exit point onto the Local Primary Road. The required visibility splays should be provided from a point in the centre of the entrance, 2.4 metres from the road edge at a height of 1.05 metre to 2.0 metres above ground level. Sight distances to be measures to the nearest road edge in both directions. The submitted revised site layout plan should demonstrate all necessary site work, including the extent of the front boundary hedge and trees which would be required to be removed/trimmed, re-grading of side banks etc to achieve the required sight distances. b) Where the sight distances are not achievable within the applicant’s ownership, the applicant should submit Legal Agreements with adjoining landowners giving their consent to allow re-locating of obstruction impeding on the visibility splays, removal of their hedgerow and hedges trimmed regularly to provide the required sight distance. The Legal Agreement and accompanying Maps shall be signed by the landowner, the applicant and witnessed by a Solicitor in accordance with exact wording of Appendix 13 of Monaghan County Development Plan 2025-2031. 4. The proposed development is considered insufficient in terms of the environmental and policy compliance information provided. In this regard the applicant is requested to: a) Submit a revised site layout plan (1:500) clearly demonstrating: i. An adequate buffer zone from drainage ditch identified on the development site and surrounding lands. ii. The location of a wheel wash structure and a waste quarantine area onsite. b) Consult with a qualified environmental consultant to confirm the absence of the invasive Japanese Knotweed within the proposed site boundary and; i. Submit a letter/report of the findings. ii. If Japanese Knotweed found to be present, applicant shall submit a Japanese Knotweed management plan outlining a strategy to control and eradicate the plant on site, submit all receipts.
