Planning Application No. 25/60502
Previous Ref. No’s.
Applicant: Geda Construction Company Ltd
Address: Scarnageeragh, Emyvale
Proposed Development: 30 Units
The application is for the development of 30 units and as such Part V is applicable.
6 no part V houses have been proposed, which is 20% and indicative costs have been provided at this
stage, which are not binding.
The Part V proposal is acceptable for compliance at this stage.
With regards the application as a whole. The housing section can support the construction of all houses
with the intention to purchase all as social housing. There are presently 25 applicants on the housing list
for Emyvale, with a further 18 applicants with neighbouring Glaslough as a preference and 500
applicants noting Monaghan town as their preference of which a number will divert their preference on
construction of houses in Emyvale hence confirming the demand for social housing.
Some additional comments from the Housing section on the application are as below.
Back alleys/pathways to rear gardens that are shown throughout and are not desirable as they can often
provide a location for antisocial behaviour and are areas that are difficult to maintain in the future. This
access can be managed in a better way, for example by providing semi-detached houses or if terrace
housing is maintained front bin stores or secured non communal access to back gardens are better
options. There are many other design solutions to these alleys.
In general, the houses lack character. There are very few features or design touches on the houses to add
to the estate and area as a whole.
The bungalows, which would be intended for those with mobility needs whilst have level front access,
should also have level access at the rear. These bungalows also seem to have a stepped rear garden
which again could be difficult for those less mobile.
If Planning Permission is to be granted it is recommended that a condition requiring compliance with
Part V is applied, this will assist Monaghan County Council in ensuring that houses are provided as
Social Housing as proposed. Where is it decided to grant permission for the development, it is essential
that the Part V condition comply with section 96(2) of the Act, as amended. It is recommended that the
planning condition should adhere closely to the wording of section 96(3) and state e.g.
“that the applicant, or any other person with an interest in the land to which the application relates shall,
prior to the lodgement of a commencement notice within the meaning of Part II of the Building Control
Regulations 1997, enter into an agreement with the planning authority under section 96 of the Planning
and Development Act 2000 with the planning authority, providing, in accordance with that section, for
the matters referred to in paragraph (a) or (b) of subsection (3) of section 96” for the provision of social
housing.
