Planning and Development Regulations 2001 (as amended). 26/60013 - retention permission and permission for the development of a storage compound the development for which retention permission is sought consists of single storey storage building, an office building and storage yard for the storage of building materials, plant and machinery. Retention permission is also sought for boundary fencing, relocation of existing entrance, concrete boundary walls, site clearance and all associated site development works permission is also sought for a wastewater treatment system, percolation area, petrol interceptors and all associated site works at Mullaghanee Castleblayney Co. Monaghan. ____________________________________________________ Dear Sir/Madam, With reference to the above application, I am to inform you that the information submitted is not adequate to enable a decision to be made. In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001 (as amended) you are hereby requested to submit further information as set out on the attached page. Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification) is not complied with within the period of 6 months from the date of the requirement for further information, or such additional period, not exceeding 3 months, as may be agreed by the Planning Authority, the planning application shall be declared to be withdrawn”. It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Monaghan ADDITIONAL INFORMATION Note: No inference is given in requesting this Further Information that planning permission will ultimately be forthcoming. The submission should take a coherent account of issues that overlap/interlink. Should the Further Information materially/significantly alter the proposed development, you are obliged to re-advertise same in accordance with Article 35 of the Planning and Development Regulations 2001 (as amended). 1. The proposed development is not located within or adjacent to a settlement. Section 15.12.2 (Industrial and Commercial Developments Outside Settlements) of the County Development Plan 2025-2031 accepts that there may be circumstances where it is not possib le or appropriate to locate a commercial or industrial development within a settlement. In these circumstances, industrial and commercial developments may be considered acceptable where it can be justified to the satisfaction of the Planning Authority. Notwithstanding the submitted information, please submit a comprehensive, itemised justification report demonstrating how the proposed development complies with the full requirements of Section 15.12.2 (a–i) of the County Development Plan 2025-2031. This report shall principally demonstrate that no suitable alternative site exists within the boundaries of nearby settlements, and the proposed development is appropriate at this location. The report shall be clear, structured, and supported by any necessary drawings, surveys or technical assessments required to allow the Planning Authority to determine whether the development meets the tests set out under Section 15.12.2 (a–i). 2. As with the assessment of your previous applications (planning file numbers 23/107 and 24/60233), flood maps indicate that the eastern edge of the site may be at risk to fluvial flooding. Accordingly, please submit an assessment of the flood risk, which cl early demonstrates that your development would not be at risk of flooding nor would it exacerbate flooding elsewhere. Should any residual risks to the development and/or area be identified, please demonstrate how same would be acceptably managed. 3. The information submitted is insufficient with regards traffic safety and access standards. Consequently, please submit the following: (a) A 1:500 site layout plan that accords with Section 15.27 of the County Development Plan 2025-2031, clearly illustrating visibility splays of 70m along the adjoining local road measured to the nearside road edge in each direction, provided from a point in the centre of the roadside entrance 2.4m from the road edge at a height of between 1.05m and 2m ab ove ground level to an object height of 0.26m and 2m above ground level in both directions. (b) If applicable, legal agreements with adjoining landowners giving their consent to allow removal/trimming of their hedgerows, etc, to provide the required 70m sight distances, where said sight distances are not achievable within the site area and where hedgerows or other such impediments beyond the site do not belong to the applicant. The legal agreements shall be accompanied by an appropriate ordnance survey map that shall also be signed and witnessed by a solicitor. 4. No justification/rationale has been offered regarding the (need for the) clearance works to the rear of the site. Accordingly, in the interest of clarity and to allow for a fully informed decision, please submit details justifying the need for said works. 5. The information submitted is insufficient with regards environmental protection. Accordingly, the following is required: (a) Submit a revised site drainage plan (1:500) demonstrating the following: (i) Existing and proposed surface water drainage systems (outlined in blue), including stormwater runoff collected via gullies. (ii) Existing and proposed foul water drainage systems (outlined in red). (iii) All associated discharge points and outfalls. (iv) Demonstrate proposed location for an adequately sized Class 1 Interceptor(s) and location of outfall(s). (v) Submit design specification details for petrol Interceptor to demonstrate adequate capacity for the entire yard area. (vi) Demonstrate proposed location for the proposed attenuation tank and the associated hydrobrake. (vii) Indicate location of a final manhole for inspection proposes prior to outfall to any surface water and foul drainage system. (b) Submit a commensurate Construction and Environmental Management Plan (CEMP), to include measures to manage, minimise, and safely dispose of the waste generated on-site.
