Planning and Development Regulations 2001 (as amended). 26/60029 - permission for a development which will consist of a new two-storey dwelling, associated garage and connecting car port, opening of a new vehicular entrance to site and wastewater treatment system and polishing filter together with all associated site development works at Gola Irish Scotstown Co. Monaghan. _______________________________________________________ Dear Sir/Madam, With reference to the above application, I am to inform you that the information submitted is not adequate to enable a decision to be made. In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001 (as amended) you are hereby requested to submit further information as set out on the attached page. Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification) is not complied with within the period of 6 months from the date of the requirement for further information, or such additional period, not exceeding 3 months, as may be agreed by the Planning Authority, the planning application shall be declared to be withdrawn”. It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Yours faithfully, __________________________ ADMINISTRATIVE OFFICER P.P. 26/60029 Aaron and Eimear Grew Gola Irish, Scotstown, Co. Monaghan ADDITIONAL INFORMATION 1. Policy PMP 1 and Section 6.18.1 of the Monaghan County Development Plan 2025 - 2031 states that ‘development adjacent to an archaeological monument or site will only be acceptable where it is sited in a manner which minimises the impact on the monument and its setting. Development which is likely to have an adverse impact upon an archaeological monument or site, or its setting shall be resisted’. The Planning Authority notes a submission from the Department of Housing and Local Government and Heritage (DHLGH). The Planning Authority has reviewed same and note the proposed development directly impacts upon the constraint area for MO008-001-Earthwork which is afforded statutory protection. This Department is concerned that any works in such close proximity to this Monument may have a negative impact on subsurface archaeological remains and may have a negative visual impact on the amenity and setting of the Recorded Monument. Having regard to same, DHLGH recommends that archaeological pre-development trenching be carried and a Visual Impact Assessment should be prepared. The applicant is requested to review the file for the full content of the DHLGH submission and respond accordingly to the issues raised. 2. Section 15.9.1 ‘Rural Character’ and Policy RCP 1 of Monaghan County Development Plan 2025 - 2031 provides for dwellings in the countryside where they will not cause a detrimental impact or further erode the rural character of an area. RCP 1 advises that “The assessment of the impact of new dwellings in the rural area will be considered from critical views along public roads, laneways, public rights of way and other areas of the public domain”. The Planning Authority has serious concerns regarding the integration of the proposed development. In particular, it is considered that the proposed dwelling would be unduly prominent due to the elevated nature of the site and would therefore have a detrimental impact on the rural character. Furthermore, concerns arise in relation to the visual impact of the development from critical viewpoints, particular when travelling from the Local Tertiary Road (L-20312-0). Owing to the opening nature of the southern boundary, it is considered that the dwelling would not successfully integrate into the surrounding landscape and would appear visually intrusive. Having regard to the above, and in conjunction with item 1, the applicant is requested to submit the following; a) A revised house design incorporating a substantially reduced ridge height; and/or b) A revised site layout relocating the proposed dwelling further away from the Recorded Monuments (MO008-001- Earthwork) and closer to the Local Tertiary Road (L-20401-0). 3. The applicant is requested to extend the site red line boundary of the application site to include the existing mature vegetation along the southern boundary, to facilitate the appropriate integration of the proposed dwelling into the rural landscape. 4. In the interest of clarity and appropriate design, the applicant is requested to confirm the floor area of the covered patio/car port areas of the proposed development. 5. In the interests of clarity and appropriate design, the applicant is requested to provide samples of proposed materials specifying its colour, texture and profile. 6. The Planning Authority has received a third-party submission in respect of the proposed development.
