26/60043 - permission for a development which will consist of a slatted\cubicle agricultural shed
with associated underground effluent storage tank, an external slurry storage tank with concrete
base and and all associated site development works at Cornagarvoge Inniskeen Co. Monaghan.

Dear Sir/Madam,
With reference to the above application, I am to inform you that the information submitted is not
adequate to enable a decision to be made.
In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001
(as amended) you are hereby requested to submit further information as set out on the attached
page.
Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification)
is not complied with within the period of 6 months from the date of the requirement for further
information, or such additional period, not exceeding 3 months, as may be agreed by the Planning
Authority, the planning application shall be declared to be withdrawn”.
It should be noted that you will be required to give notice in an approved newspaper under article
35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development
Regulations 2001 (as amended) if the further information received is considered to contain
significant additional data.

Different Information, 6 copies of additional information to be submitted.

ADDITIONAL INFORMATION
1. (a) The Planning Authority notes that there are existing agricultural buildings within the
application site which do not appear to have the benefit of planning permission and/or
fail to correspond with the details of original planning permission for this site, planning
reference 12/35. The applicant is therefore requested to provide clarification with
regard to same.
(b) Where the applicant intends to retain existing structures as part of an amended
proposal, appropriately amended details should be provided (i.e. drawings/forms etc)
and the development description amended accordingly. The applicant should note that
this information will constitute significant further information and, in accordance with
Article 35 of the Planning and Development Regulations 2001 (as amended), revised site
and press notices should be submitted to the Planning Authority indicating the revisions
to the application.
(c) In the interests of clarity, and having regard to item (b) above, the applicant is requested
to provide a concise report demonstrating how the conditions of original permission for
this site 12/35, have been satisfactorily complied with.
2. The applicant has failed to provide sufficient information to demonstrate full compliance with
Section 15.13.1 ‘General Requirements for Agricultural Development’ and associated policy AGP
1 of the Monaghan County Development Plan 2025-2031. The applicant is therefore requested
to submit the following additional documentation, in the interests of public health and
environmental protection;
(a) A revised site drainage plan which clearly outlines all soiled drainage paths from soiled
yards, collecting yards, silage bases and bedded sheds (in red), storm lines (in blue) and
the location of all associated outfall points. This plan should clearly demonstrate all
provisions for the collection of soiled waters, run-off/seepage and effluent generated
within the farmyard. Reference should be given to the statutory requirements outlined
within Part 2 of the European Union (Good Agricultural Practice for Protection of
Waters) Regulations, 2025.
(b) Clarification on whether or not there is a dairy washings tank on site and if so, submit
measurements of same.
(c) Additional information to demonstrate compliance with specified limits for nitrogen
loading as required by the European Union (Good Agricultural Practice for Protection of
Waters) Regulations, 2025. A Nitrogen and Phosphorus statement (N&P) statement and
a copy of the farmer full nutrient management plan should also be submitted.
Note: It is recommended that the applicant/agent liaises with Environmental Section and
Planning Section prior to the preparation and submission of this Further Information.
