Re: 25/60402 Trevor McBride.
Permission: Planning permission to construct 1 No. poultry house together with all ancillary
structures (to include meal storage bin(s)) and site works associated with the
development This application relates to a development which is for the purposes of
an activity requiring a licence under part IV of the environmental protection agency
(Licensing) regulations 1994 to 2013, An environmental impact assessment report
(E.I.A.R) will be submitted with the planning application.
Location Shanmullagh, Clontibret, Co. Monaghan.
Date: 08/04/2026
Background
The following further information was requested:
a. Submit an up-to-date Nutrient Management Plan Assessment demonstrating that the
available spread lands have the capacity to accept soiled waters arising from the
development.
A Nutrient Management Plan has not been submitted with the additional information
received.
b. Submit details of the outlet for manure arising from the proposed development to include the
destination(s) and the purpose for which the manure will be used.
The additional information has stated that manure will be used as an organic fertilizer,
mainly on tillage land and will be removed by a haulier registered with the Department of
Agriculture, Food and the Marine, however, no details of the lands on which the manure
will be spread have been provided. The response also states that manure may be used in
anaerobic digesters or similar facilities. In light of the intended landspreading of manure on
tillage land, the information provided does not demonstrate how it is proposed to store
manure produced during the closed period which is required by the European Union (Good
Agricultural Practice for Protection of Water Regulations), 2025.
c. Submit details on the outlet for dead birds from the proposed development. The address on
the letter submitted with the application is Downs, Clontibret, Co. Monaghan which is
inconsistent with the proposed development address.
A letter from College Proteins has been submitted as part of the additional information
specifying the correct address.
Recommendation
The applicant has not submitted a Nutrient Management Plan and has therefore not sufficiently
demonstrated that the proposed development will maintain a stocking rate of less than 170Kg N/Ha.
The applicant has also failed to demonstrate the outlets for manure arising from the proposed
development.
I recommend refusal of this application as information submitted is not sufficient to demonstrate how
it is proposed to comply with the requirements of the European Union (Good Agricultural Practice for
Protection of Waters) Regulations 2025 and as a result it has not been demonstrated that the
proposed development will not adversely impact the on the water environment.
Therefore, compliance with AGFO 2 in the County Monaghan Development Plan 2025-2031 has not
been demonstrated.
AGFO 2 To control, though the development management process and the relevant environmental
legislation, effluent spreading on land in order to protect ground and surface water sources in the
County. Developers are required to comply with relevant Department of Agriculture, Food and the
Marine Guidelines and the Nitrates Regulations in this regard.
