Permission: Permission will consist of the re-contouring of existing undulating
agricultural farmland to include the importation of soil, subsoil and inert material in order to
raise the levels of part of the land together with all ancillary site development works. The
lands will be recovered with topsoil and reseeded with ryegrass upon completion of the re-
contouring works.

Environmental Report
Background
The planning application site is located in located in the Major Lough Stream 010
subcatchment . The ecological status of the is waterbody is poor and is at risk of not
meeting its Water Framework Directive Targets by 2027. The groundwater vunerability is
extreme but the underlying aquifer is poorly productive.
The additional information requested has been addressed as follows:
a. The applicant shall provide clarification on the classes of activity requested in
accordance with the Third Schedule Part II of the Waste Management (Facility
Permit and Registration) Regulations 2007 as amended.
The site to be infilled with Greenfield soil and stone only under Article 27.
b. The applicant shall have the following assessment completed by a qualified
Environmental Consultant and a report submitted demonstrating the
following:
i) Demonstrate the suitability of the proposed development site for the
importation of the proposed waste material. This shall include an
assessment on the impact this development and the proposed waste
type will have on groundwater and surface water, including
identification of potential pathways to groundwater and surface water
and any nearby drinking water supply sources and wells and identify
proposed mitigation measures to protect groundwater and surface
water from activities associated with this development.
The Environmental assessment indicates that no water supplies or
wells exist in proximity to the site nor is the site within an inner or outer
source protection zone for water supply sources. A 5m buffer zone
adjacent watercourse is proposed to prevent discharge of sediment
laden waters. A wheel wash is proposed to reduce sediment losses via
road surface.
c. The applicant shall submit the following;
i) a revised site layout plan and site section plan clearly demonstrating;
1) surface water drainage ditches onsite and in close proximity to
the site, including dry drainage ditches that have the potential
to hold surface water.
Submitted and adequate
2) An adequate buffer zone from drainage ditches identified on
the development site and surrounding lands.
3) 5m buffer proposed along watercourse
4) The applicant shall demonstrate on the revised site layout plan
the location of the wheel wash structure (if applicable as per
point c.) and a waste quarantine area onsite
Detailed on submitted drawing
d. The applicant shall submit a revised tonnage of waste material proposed to be
imported and infilled onsite taking into account a reduced infill area onsite
as a result of buffer zones.
e. The applicant shall submit an agricultural improvement plan demonstrating no
net loss to biodiversity or water quality.
Not submitted but included in environmental assessment. To be submitted
prior to commencement
Recommendation:
I have no objection to planning subject to the following conditions:
a) One month prior to commencement of the development, the applicant must submit
a revised topographical survey demonstrating phased stages for infill works.
b) One month prior to commencement of the development, the applicant must submit
for approval by Environment Services, an agricultural improvement plan, prepared by
a suitably qualified agricultural advisor.
c) Economic operator shall utilise EPA By-Product Regulation 27 in moving soil infill
material from one site to another.
d) There shall be no more than 24,000 tonnes of greenfield soil and stone imported onto
the site.
e) No waste of any other type including brownfield and construction and demolition
waste to be imported onto the site.
f) An up to date resister, detailing importers, quantities, and dates of delivery of all loads
of soil and stone imported to the site must be kept available for inspection by the Local
Authority
g) Hedgerow or tree removal shall not take place during the bid nesting season.
h) A 10 meter buffer strip must be in place between the infill area and surface
watercourse. The buffer strip to be clearly marked with colored posts. The area
between the buffer strip and infill area to be separated by means of an impermeable
soil beam.
i) Facilities shall be provided for the collection and segregation of recyclable waste.
Wastes shall be collected for recycling/reuse whenever feasible or otherwise disposed
of in accordance with the Waste Management Act 1996 as amended.
j) The developer shall ensure that adequate measures and precautions are in place for
the construction phase to ensure there is no discharge of polluting matter/sediment
laden waters discharging from the site to any watercourse. These measures shall take
account of the Guidance produced by Inland Fisheries Ireland titled “Requirements for
the Protection of Fisheries Habitat during Construction and Development Works at
River Sites”, available to download at https://www.fisheriesireland.ie/documents/624-
guidelines-on-protection-of-fisheries-during-construction-works-in-and-adjacent-to-
waters/file.html.
k) Monaghan County Council and Inland Fisheries Ireland shall be informed promptly of
an accidental spillage of sediment laden waters, fuel, machine oil or any polluting
discharge which may threaten the quality of any watercourse or groundwater body.
l) Any fuels, oils, greases, hazardous liquid wastes and hydraulic fluids within the site
area shall be stored on site, away from any watercourses in a bunded, leak-proof, and
lockable storage area. Note that bunds are to be designed to contain 110% of the
capacity of the largest storage container located within the bund. There shall be no
overflow drain facility from any bunds on site and all filling and off-take points shall be
located within a bund.
