From: Kieran Kerley, Environment Section
Ref: 25/60433 Richard Mc Chesney, Derryarrilly, Castleblayney, Co Monaghan
Agent: Stephen Moffett
Permission to construct a turkey rearing house together with all ancillary structures including,
vertical meal bin and underground washings tank, along with all associated ancillary site works
using existing shared private access lane at Derrygarrilly, Castleblayney, Co. Monaghan as per
application No. 25/60433.
The proposed development site is located on an area of extreme groundwater vulnerability which is
underlain by a Poor Aquifer. The site is located adjacent to the Clontibret 020 stream. This waterbody
has been classified as being of Moderate Status, 2019-2024 with an objective of improving to Good
Status by 2027. The EPA near surface nitrate susceptibility maps indicate that the site is in an area
which susceptible to losses of nitrogen. It is imperative that the site is managed in a manner which
prevents the runoff of any organic fertilisers or soiled waters either directly or indirectly to receiving
surface waters in accordance with the requirements of the European Union (Good Agricultural
Practice for the Protection of Waters) Regulations, 2022.
In order to make a fully informed decision on the application the following additional information
listed in bold was requested with observations in red;
1. Submit details of authorisation from DAFM for the contractor used for the collection of dead
birds arising from the proposed development.
DAFM certificate of registration for Irish Bait & Tackle Ltd (No. HAC2193) has been
submitted.
2. Submit a Construction Environmental Management Plan (CEMP), this plan shall take
account of guidance produced by Inland Fisheries Ireland titled “Guidelines on Protection of
Fisheries during Construction Works in and Adjacent to Waters 2016”. This document is
available to download at https://www.fisheriesireland.ie/publications.
This piece of additional information requested in my report was not communicated to the
applicant/agent in the FI request but must be submitted 2 months prior to the
commencement of any development.
3. (i) A Construction and Demolition and By-Products Waste Management Plan for the
proposed development works. The plan shall be prepared using “Best Practice Guidelines
for the preparation of resource & waste management plans for construction and demolition
projects” – EPA, 2021.
(ii) An Asbestos Survey and Removal Plan for the proposed or completed demolition works.
Response from agent is somewhat vague in relation to removal of any asbestos from the
demolished poultry house. Any Asbestos would have had to be removed separately to the
rubble under a hazardous EWC code. 2 months prior to commencement applicant/agent
must submit the following;
• Waste dockets for the removal and disposal of asbestos arising from the demolished poultry
unit.
