Permission: permission for development the development works will consist of:
The importation of subsoil and construction waste to raise existing ground (not
exceeding 25,000 Tonnes) use of existing entrance and all associated site works. The
class of activity will be; Class , 5, 6 and 7 of the Third schedule Part II of the Waste
Management (Facility Permit & Registration) Regulations, 2007 as amended.
_________________________________________________________________________________
The proposed development lies in the Fane 040 sub catchment which is currently at
poor ecological status and at risk of not meeting its water framework directive targets.
The pressures associated with this water body are abstraction, pasture and run off. The
groundwater vunerability at the proposed site if high to extreme.
The Proposed activity would require a Certificate of Registration ( S.I. No. 821/2007 -
Waste Management (Facility Permit and Registration) Regulations 2007). The proposed
classes of activity are as follows:
Class 5 (Soil/Dredging): The recovery of excavated or dredged spoil (natural materials
like clay, silt, sand, gravel, or stone) for land reclamation or improvement. Updated
regulations mean this can accommodate up to 200,000 tonnes.
Class 6 (Inert/C&D Waste): Recovery of inert waste (e.g., concrete, brick, tile) to
improve or develop land, often used in conjunction with Class 5, with limits generally
up to 50,000 tonnes.
Class 7 (Industrial/Other): Recovery of other types of inert waste or specific industrial
by-products for beneficial
Part of the proposed site lies in a wetland (Aughrim More). The remainder of the site lies
between two areas of wetland Aughrim more to the North and Aughrim Beg to the South
East. The site is elevated and rock outcrop exists at surface. It has been uncultivated
previously. The impact on filling this site would fragment the existing wetlands and
reduce the remaining carbon store further. Filling the site would alter the hydrological
pathways to both, resulting in a potential loss to biodiversity and eco system services.
Recommendation:
I recommend refusal of this application due to the reasons outlined above.
