Planning and Development Regulations 2001 (as amended). 26/60105 - retention permission for change of finished floor levels, change of ground levels and change of boundary fencing from that previously approved granted planning permission under planning reference (24/60094) at Annahale Castleblayney Co Monaghan. _______________________________________________________ Dear Sir/Madam, With reference to the above application, I am to inform you that the information submitted is not adequate to enable a decision to be made. In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001 (as amended) you are hereby requested to submit further information as set out on the attached page. Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification) is not complied with within the period of 6 months from the date of the requirement for further information, or such additional period, not exceeding 3 months, as may be agreed by the Planning Authority, the planning application shall be declared to be withdrawn”. It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Please Note: 4 copies of Additional Information to be submitted. In the case of Significantly Different Information, 6 copies of additional information to be submitted. Yours faithfully, __________________________ ADMINISTRATIVE OFFICER pp 26/60105 Martin McElroy Annahale, Castleblayney, Co Monaghan ADDITIONAL INFORMATION Note: The submission should take a coherent account of any issues that overlap/interlink. Should the Further Information materially/significantly alter the proposed development, you are obliged to re-advertise same in accordance with Article 35 of the Planning and Development Regulations 2001 (as amended). No inference is given in requesting this Further Information that planning permission will ultimately be forthcoming. You and/or your assigned agent may wish to liaise with Planning Section prior to the preparation and submission of this Further Information. 1. The development as-built differs notably in respect of ground and floor levels from that permitted previously under planning file number 24/60094. In the interest of clarity and to allow for a fully informed decision, and notwithstanding the details submitted, please submit revised site layout plans and overlayed cross-sections (through each house in both front-to- rear and side-to-side directions) clearly and accurately showing: (i) Permitted ground, floor and ridge levels. (ii) As-built ground, floor and ridge levels. (iii) Road levels. (iv) Adjacent ground levels and properties. All sections shall be taken through the main body of each house and shall be clearly referenced on the site layout plans. 2. It is stated that increased ground levels arose due to site constraints, and that ridge levels have been reduced to mitigate same. However, this has not been clearly demonstrated in the information submitted. Accordingly, please provide a detailed statement and supporting drawings clearly demonstrating why the permitted levels could not be achieved and why alternative design approaches were not considered. In addition, please clearly demonstrate, by way of drawings and supporting information, that the development as-built (i) does not give rise to undue visual prominence or impact, and (ii) maintains an acceptable relationship with adjoining properties. 3. On inspection, the Site 1 garden areas are largely composed of compacted clay with limited vegetative cover, while the corresponding areas to Site 2 remain mainly unfinished, comprising exposed subsoil and fill material. In both instances, having regard to the increased ground levels across the sites, the conditions raise concerns in respect of reduced permeability and potential surface water runoff toward the rear boundaries and adjoining lands. Accordingly, you are requested to submit details of surface water management measures for the sites, including (i) how surface water runoff from rear garden areas is to be managed, and (ii) confirmation that no surface water will discharge onto adjoining properties. Where necessary, proposals shall include measures to improve ground permeability and/or the provision of appropriate drainage infrastructure along the rear boundaries.
