The proposed development will consist of the extension of the existing ground-floor retail unit through amalgamation with the adjoining premises to provide an enlarged retail floor area, including internal alterations and reconfiguration works. The development will further consist of the change of use and conversion of the existing unoccupied first and second floors into 2 No. self-contained one-bedroom studio apartments, together with all associated site development works. The proposed works pertain to Protected Structures identified in Appendix 1(b) — the Record of Protected Structures for Monaghan Town — within the Monaghan County Development Plan 2025–2031, specifically Reference Nos. 41001180 and 41001179. The development site is located within the Blackwater [Monaghan]_SC_010 subcatchment, and within the Shambles_010 sub-basin which has been assigned Poor status under the Water Framework Directive status (2019 - 2024) with an objective of Restore. The application states that foul water will discharge to the public sewer via an existing connection. The application states that storm water will discharge to the public storm sewer via an existing connection. Recommendation I have no objection to planning subject to the following conditions: a) One month prior to commencement of the development, the applicant shall submit a fully completed Water Protection Plan checklist. b) One month prior to the commencement of the development, the applicant shall submit a Construction and Demolition and By-Products Waste Management Plan for the proposed development works. The plan shall be prepared using “Best Practice Guidelines for the preparation of resource & waste management plans for construction and demolition projects” – EPA, 2021. An Asbestos survey and removal plan, if necessary, for the proposed development works shall be included. c) Any construction and demolition waste or excess soil generated during the construction phase which cannot be reused on site in accordance with Section 3 (1)(c) and Section 39 (1) of the Waste Management Act 1996 as amended, shall be disposed/recovered at an appropriately permitted facility in accordance with the requirements of the Waste Management Act 1996 as amended using authorised waste collectors authorised to collect the type of material for disposal/recovery at authorised treatment facilities. d) Facilities shall be provided for the collection and segregation of recyclable waste. All waste shall be collected for recycling/reuse whenever feasible or otherwise disposed of in accordance with the Waste Management Act 1996 as amended. e) Where a commercial activity involved in the preparation of food occupies the proposed retail area, a suitably size grease trap shall be installed for all wash sinks and equipment. Grease traps shall be maintained as per manufacturers’ specifications and fats, oils and greases shall be collected by a suitably permitted contractor in accordance with the requirements of the Waste Management Act, 1996 as amended. f) The applicant shall ensure completely separate foul and surface water drainage systems are in place. g) An as-built CCTV survey shall be carried out within one month of completion of development to ensure completely separate storm and foul water drainage systems and no misconnections have occurred. Any misconnections identified shall be rectified. The full report shall be submitted to Monaghan County Council within 2 months of completion of the development. h) The developer shall ensure that adequate measures and precautions are in place for the construction phase to ensure there is no discharge of polluting matter/sediment laden waters discharging from the site to any watercourse. These measures shall take account of the Guidance produced by Inland Fisheries Ireland titled “Requirements for the Protection of Fisheries Habitat during Construction and Development Works at River Sites”, available to download at https://www.fisheriesireland.ie/documents/624-guidelines-on-protection-of- fisheries-during-construction-works-in-and-adjacent-to-waters/file.html i) Monaghan County Council and Inland Fisheries Ireland shall be informed immediately of an accidental spillage of sediment laden waters, fuel, machine oil or any polluting discharge which may threaten the quality of any watercourse or groundwater body. j) Any fuels, oils, greases, hazardous liquid wastes, and hydraulic fluids within the site area shall be stored on site, away from any watercourses in a bunded, leak-proof, and lockable storage area. Note that bunds are to be designed to contain 110% of the capacity of the largest storage container located within the bund. There shall be no overflow drain facility from any bunds on site and all filling and off-take points shall be located within a bund. k) Material storage, fuel handling, and other yard activities shall be managed in a manner which prevents the discharge of polluting matter to ground or surface water.
