To Monaghan County Council Planning Department,
I refer to the Notification of Decision dated 05/05/2026 in respect of Planning Ref.
25/60383 relating to development at Mulladuff, Smithborough.
I wish to raise a concern regarding the condition of the boundary treeline adjoining my
property, which was the subject of a complaint submitted prior to the issuing of this
decision.
While I note that Condition 3 of the grant requires the protection of existing trees and
hedgerow and the submission of a landscaping scheme, the excavation works which
impacted the treeline had already been carried out at the time the decision was issued.
As such, the condition does not appear to address the damage that has already
occurred.
The bank along the boundary has been cut back, with significant root exposure visible
along the treeline. This has likely compromised the structural stability and long-term
health of the affected trees. In its current state, I am concerned that the trees are at
increased risk of failure, particularly during adverse weather conditions.
Given the extent of the excavation and exposed root systems, I consider that remedial
works will be required, such as reinstatement of the bank profile and rebuilding of the
root zone to support and stabilise the affected trees. An arborist will be able to advise
on the best approach to ensure the root zone is properly reinstated.
In this context, I would appreciate clarification from the Planning Authority on how the
existing damage to the treeline will be addressed. In particular:
• Whether the Council Arborist can inspect the site and provide advice on
necessary stabilisation or remediation measures to include within the plannin
conditions; or
• Whether the developer will be required to engage a suitably qualified arborist
(not only a landscaper) to assess the damage and prepare a method statement
for remedial works to ensure the long-term retention of the trees.
I would be grateful if this matter could be reviewed as part of the
enforcement/monitoring process associated with this permission, as I do not believe
that the current condition adequately addresses the damage that has already taken
place.
I look forward to your response.
Yours sincerely,
Phelim Mac Elwain
