The site is located within the Fane_010 river waterbody, this waterbody has been classified as “Poor” status with an objective of restore to “Good” Status by 2027. The site is on an area of extreme groundwater vulnerability which is underlain by a poor locally important aquifer. Additional information was requested. • Submit a completed Water Protection Plan checklist for the proposed development. A Water Protection Checklist has been submitted. However it is the old Water Protection Checklist Plan Checklist and not the updated version as per the new County Development Plan 2025-2031. • Submit a revised site layout plan (1:500) demonstrating the following: o All existing and proposed surface/storm water drainage systems (outlined in blue). o The directional flow of all existing/proposed surface water pipelines. o Any interceptors servicing the carparking and/or yard areas. o Any SuDS measures for storm drainage. o All associated discharge points and outfalls. o The truck wash area o The proposed wastewatrer treatment plant. o All existing and proposed foul water drainage systems (outlined in red). A revised site layout and drainage plan was submitted. Foul water from the truck wash has been identified, it will go through an interceptor and connect to the existing foul water drainage and to the proposed new wastewater treatment system. Storm water from the yard areas and car park will discharge to the land area where the existing percolation area is. No interceptor has been identified for storm drainage from the car park. 26/60052 The site drainage plan still identifies the proposed hydrobrake post the reed and willow bed system and the wastewater discharge also includes stormwater. The treatment system sampling location should not include storm water discharges. This will be clarified further in the section 4 discharge licence application. On the revised site drainage plan foul and storm water are separate. If planning is to be granted, I recommend the following conditions: 1. Prior to development applicant to obtain a licence review of their existing Section 4 Discharge Licence in accordance the Water Pollution Act 1977 as amended. 2. The facility shall be operated in accordance with their Section 4 Discharge Licence, or any subsequent review thereof. 3. The applicant shall ensure completely separate foul and surface water drainage systems are in place. 4. Material storage, fuel handling, parking areas and other yard activities shall be managed in a manner which prevents the discharge of polluting matter to ground or surface water. 5. Wash water from the truck wash and storm water arising from the proposed development shall discharge to appropriately sized and suitable Class 1 interceptors prior to discharge. Interceptors shall be provided with appropriate warning device to indicate when required levels for maintenance have been reached and should be fitted with a sampling chamber, which has easy access. An inspection manhole shall be installed on the outflow pipe from the oil interceptors. 6. Fuel/Oil interceptor shall be serviced regularly, maintained, and installed as per manufactures recommendations to prevent any discharge of pollutants to ground or surface waters. Maintenance records shall be kept by the applicant. 7. Any accidental discharge, spillage or deposit of any polluting matter from the premises which enters or is likely to enter any waters shall be reported to Monaghan County Council Environment Section and Inland Fisheries immediately. 8. Prior to development submit a Construction and Environmental Management Plan (CEMP) for agreement. This plan shall be sufficient to demonstrate that adequate measures will be in place for the construction phase to ensure there is no discharge of polluting matter/sediment laden waters to any waters. The Construction and Environmental Management Plan shall take account of best practice and the guidance produced by Inland Fisheries Ireland titled “Guidelines on Protection of Fisheries during Construction Works in and Adjacent to Waters 2016” and shall include the identification of potential pathways to the groundwater aquifer and the River Fane. The CEMP shall be prepared by a suitably qualified person and shall include the location details of the monitoring points where daily visual checks and weekly surface water monitoring (physical& chemical parameters) shall be carried out. 9. Any construction and demolition waste or excess soil generated during the construction phase which cannot be reused on site in accordance with Section 3 (1)(c) and Section 39 (1) of the Waste Management Act 1996 as amended, shall be disposed/recovered at an appropriately 26/60052 permitted facility in accordance with the requirements of the Waste Management Act 1996 as amended using authorised waste collectors authorised to collect the type of material for disposal/recovery at authorised treatment facilities. 10. If infilling material is required to be imported onsite the applicant or economic operator shall: (a) Utilise EPA By-Product Regulation 27 in moving soil infill material from one site to another. Official correspondence demonstrating Article 27 Registration with the EPA shall be submitted to the Planning Authority prior to commencement of development. or (b) If using waste material as infill and prior to acceptance of material a valid permit must be issued by Monaghan County Council in accordance with the Waste Management (Facility Permit and Registration) Regulations 2007 as amended. or (c) Buy topsoil material as a product for final landscaping purposes only. Documentation demonstrating purchase shall be submitted to Planning Authority. 11. Submit a Construction and Demolition and By-Products Waste Management Plan for the proposed development works. The plan shall be prepared using “Best Practice Guidelines for the preparation of resource & waste management plans for construction and demolition projects” – EPA, 2021 12. All waste oils and any other hazardous waste materials shall be stored appropriately and collected, recovered or disposed of in accordance with the Waste Management Act 1996 as amended, and records of such shall be kept on site. 13. (i) All hazardous liquid waste or oil/fuel storage containers, temporary or otherwise, shall be bunded. (ii) All bunds will be designed to contain 110 % of the capacity of the largest storage container located within the bund. (iii) There shall be no overflow drain facility from any bunds on site and all filling and off-take points shall be located within a bund. 14. Facilities shall be provided for the collection and segregation of recyclable waste. Wastes shall be collected for recycling/reuse whenever feasible or otherwise disposed of in accordance with the Waste Management Act, 1996 as amended.
