Monaghan at Enagh Rockcorry Co. Monaghan. _______________________________________________________ Dear Sir/Madam, With reference to the above application, I am to inform you that the information submitted is not adequate to enable a decision to be made. In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001 (as amended) you are hereby requested to submit further information as set out on the attached page. Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification) is not complied with within the period of 6 months from the date of the requirement for further information, or such additional period, not exceeding 3 months, as may be agreed by the Planning Authority, the planning application shall be declared to be withdrawn”. It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Section 15.22.8 of the Monaghan County Development Plan 2025-2031 states that all development proposals in flood risk areas should be supported with a site-specific Flood Risk Assessment (FRA), in accordance with the DECLG, The Planning System and Flood Risk Management Guidelines for Planning Authorities (2009) and Departmental Circular PL2/2014. The Office of Public Works (OPW) Preliminary Flood Risk Assessment (PFRA) maps indicate that part of the application site is vulnerable to pluvial flooding events. In this regard, the Applicant shall submit a Flood Risk Assessment for the proposed development, completed by a competent professional with hydrological experience, confirming that the development: • Will not be at risk of flooding • Will not exacerbate flooding in the immediate vicinity or wider area. • Will not obstruct or impede important flow paths • Will not result in residual risks to the area and/or development that cannot be managed to an acceptable level. The flood risk assessment shall also clearly demonstrate proposed management of any residual risks. 2. The proposed development is considered insufficient in terms of the environmental information provided. In this regard, the applicant is requested to: a) Submit a revised agricultural planning application to include the correct applicant’s name and address. b) Clarify whether storm water will discharge to a soak-pit as stated in Section 1.1 of the Proposed Development Description, and if so, demonstrate that the proposed soak-pit design is suitable for ground conditions and will present no environmental risk to water quality. c) Submit revised proposals for the storm water drainage system to take account of the Department of Housing, Local Government and Heritage guidance document on Nature- based Solutions to the Management of Rainwater and Surface Water Runoff in Urban Areas. d) Clarify the volumes and measurements of all proposed soiled water tanks. e) Submit a revised site layout plan demonstrating the following; i. All proposed surface/storm water drainage systems (outlined in blue). ii. The directional flow of all surface water pipelines. iii. Proposed nature-based solutions for surface water. iv. All associated discharge points and outfalls. v. All proposed effluent / soiled water drainage systems (outlined in red). vi. All soiled water storage tanks including volumes and dimensions of same. f) Submit details on the outlet for poultry manure from the proposed development. The address on the letter submitted with the application is Derrykinard, Swans Cross, Co. Monaghan which is inconsistent with the proposed development address. The letter shall also clarify the frequency of poultry manure collections from the proposed development. g) Taking account of the land to be used for the proposed development, demonstrate that the remaining spread lands have capacity for all proposed wash waters, including proposed imported wash waters, so as to not result in a stocking rate of greater than 170kg N/Ha. h) Submit a Construction and Environmental Management Plan (CEMP) for agreement. This plan shall be sufficient to demonstrate that adequate measures will be in place for the construction phase to ensure there is no discharge of polluting matter/sediment laden waters to any waters. The Construction and Environmental Management Plan shall take account of best practice and the guidance produced by Inland Fisheries Ireland titled “Guidelines on Protection of Fisheries during Construction Works in and Adjacent to Waters 2016” and shall include the identification of potential pathways to the groundwater aquifer and the Dromore River. The CEMP shall be prepared by a suitably qualified person and shall include the location details of the monitoring points where daily visual checks and weekly surface water monitoring (physical& chemical parameters) shall be carried out.
