Monaghan. _______________________________________________________ Dear Sir/Madam, With reference to the above application, I am to inform you that the information submitted is not adequate to enable a decision to be made. In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001 (as amended) you are hereby requested to submit further information as set out on the attached page. Article 33(3) states that “where a requirement under sub-article (1) or sub-article (2) (Clarification) is not complied with within the period of 6 months from the date of the requirement for further information, or such additional period, not exceeding 3 months, as may be agreed by the Planning Authority, the planning application shall be declared to be withdrawn”. It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. In the interests of environmental protection the applicant is requested to provide the following information; (a) clarification on whether or not storm water will discharge to a soak-pit, as stated in Section 1.1 of the ‘Proposed Development Description’ statement, and if so, demonstrate that the proposed soak-pit design is suitable for ground conditions and will not present an environmental risk to water quality. (b) revised proposals for the storm water drainage system to take account of the Department of Housing, Local Government and Heritage (DHLGH) guidance document on ‘Nature-based Solutions to the Management of Rainwater and Surface Water Runoff in Urban Areas’. (c) clarify the volumes and measurements of all proposed soiled water tanks. (d) submit a revised site layout plan demonstrating the following; i. all proposed surface/storm water drainage systems (outlined in blue). ii. the directional flow of all surface water pipelines. iii. proposed nature-based solutions for surface water. iv. all associated discharge points and outfalls. v. all proposed effluent / soiled water drainage systems (outlined in red). vi. all soiled water storage tanks including volumes and dimensions of same. (e) a letter from the poultry manure haulage contractor clarifying the frequency of poultry manure collections. (f) additional information to demonstrate that the remaining spread lands have capacity for all proposed wash waters, including proposed wash waters from planning reference 26/60154, so as to not result in a loading rate of greater than 170kg N/Ha. Submitted details shall take account of the land to be used for the proposed development under current application planning reference 26/60154. (g) a Construction and Environmental Management Plan (CEMP). The submitted CEMP shall; i. be sufficient to demonstrate that adequate measures will be in place for the construction phase of the development to ensure there is no discharge of polluting matter/sediment laden waters to any waters, ii. include the identification of potential pathways to the groundwater aquifer and the Dromore River. iii. include the location details of the monitoring points where daily visual checks and weekly surface water monitoring (physical and chemical parameters) shall be carried out. iv. take account of Inland Fisheries Ireland (IFI) guidance document entitled ‘Guidelines on Protection of Fisheries during Construction Works in and Adjacent to Waters 2016’. v. be prepared by a suitably qualified person. 2. The Planning Authority notes that the applicant seeks to create a new access onto the local tertiary road (L-25022-0) to serve the proposed development. In accordance with Section 15.23.1 of the Monaghan County Development Plan 2025-2031, development involving the creation of an access and/or the provision of visibility splays, will only be permitted where the applicant is able to demonstrate control, or the reasonable prospect of acquiring control, of any land required for the provision of any access and/or visibility splays. In this regard, it is unclear from the submitted site layout plan as to the extent of tree/hedgerow removal that would be required to facilitate the proposed entrance arrangements. Furthermore, it appears from the submitted site layout plan that the proposed south-western visibility splay encroaches on third party lands. In the interests of road safety, the applicant is required to submit the following information to ensure the application fully accords with section 15.23 and 15.23.1 of the Monaghan County Development Plan 2025-2031; i. A revised site layout plan (1:500 scale) indicating how a clear and unobstructed visibility splays of 50m can be achieved at the proposed entry/exit point onto the adjoining public road. The required visibility splays should be provided from a point in the centre of the entrance, 2.4 metres from the road edge at a height of 1.05 metre to 2.0 metres above ground level to an object height of 1.05 metres to 2.0 metres above ground level in both directions. The submitted revised site layout plan should demonstrate all necessary site work, including the extent of the front boundary hedge and trees which would be required to be removed/trimmed, re-grading of side banks etc to achieve the required sight distances. ii. Where the sight distances are not achievable within the applicant’s ownership, the applicant should submit legal agreements with adjoining landowners giving their consent for all necessary works to facilitate the required 50 metre sight distances, including removal/trimming of hedgerow/hedges, re-grading of side banks etc. The Applicant should note that legal agreements should be submitted using the Appendix 13 template ‘Form of Agreement in respect of forward and rear visibility’ as contained in the Monaghan County Development Plan 2025-2031. 3. Policy LCP 1 and Section 15.22.4 ‘Landscaping and Boundary Treatment’ of the Monaghan County Development Plan 2025-2031 stipulates that all development proposals should be accompanied by a landscaping plan commensurate to the scale of development proposed. In the interests of ensuring that the development is adequately integrate, the applicant is requested to provide revised site layout/landscaping plans indicating additional hedgerow and tree planting along the sites, new and currently undefined, northern boundary. Note: The applicant is invited to liaise with the Monaghan County Council Planning Section, Environment Section, and the MD Roads Engineer prior to preparing the documentation requested above.
