In accordance with the provisions of Article 33 of the Planning and Development Regulations 2001 (as amended) you are hereby requested to submit further information as set out on the attached page. It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Please Note: 4 copies of Additional Information to be submitted. In the case of Significantly Different Information, 6 copies of additional information to be submitted. Yours faithfully, __________________________ ADMINISTRATIVE OFFICER pp 26/60176 Priyanka Nilkam & James Mohan Mullaghanee, Castleblayney, Co. Monaghan ADDITIONAL INFORMATION Note: Your assigned agent shall liaise with Planning Section prior to the preparation and submission of this Further Information. Should the Further Information materially/significantly alter the proposed development, you are obliged to re-advertise same in accordance with Article 35 of the Planning and Development Regulations 2001 (as amended). 1. The site is located within the preferred route corridor for the N2 Ardee to Castleblayney Road Scheme. Policy NRP 3 of the County Development Plan 2025-2031 seeks to resist development that could add cost, complexity or prejudice the delivery of National Road projects. Following extensive discussions on road impacts and lands required to deliver the road scheme, previous planning application file number 24/60291 was approved on this site based on a pre- agreed site boundary. Whilst this application proposes a similar development, the site boundary has changed and now encroaches on the current proposed CPO boundary for the road scheme. This has the potential to add cost, complexity and/or prejudice the delivery of the project. Accordingly, please acknowledge said concern and submit revised drawings that comply with Policy NRP 3 and are to the satisfaction of the Project Liaison Officer. 2. The existing infill and raising of ground levels on-site has not been factored into the proposed development, as it was previously under planning application file number 24/60291. Accordingly, in the interests of clarity and to allow for a fully informed decision, please (re)advertise the development, as significant further information under Article 35 of the Planning and Development Regulations 2001 (as amended), to also include permission to retain the existing infill and raising of ground levels on-site. You will need to submit revised and/or further plans and documents accordingly, along with copies of the significant further information site and press notices. 3. The information submitted is insufficient with regards environmental protection. Accordingly, the following is required: a) The applicant shall submit a revised site layout plan clearly demonstrating: i. The areas within the proposed development site previously infilled; ii. Proposed foul water drainage system (marked in red); and iii. Proposed surface water drainage system and associated outfalls (marked in blue). b) Submit a completed Water Protection plan checklist for the proposed development. c) Clarify if further infill material will be required at the proposed development site and the type of authorisation proposed. d) A risk assessment shall be carried out by a suitably qualified and competent person, such as an Environmental Consultant, to determine if the infilled material on-site is suitable for use as infill material. A report shall be provided and shall include the following: i. Origin and volume (tonnes) of fill material already infilled at the proposed development site; ii. Representative samples taken from a number of trial holes. The taking of these samples shall be suitably supervised; iii. Basic characterisation, i.e. laboratory analysis on the representative samples, shall be completed and shall include screening for Asbestos. The characterisation shall be used to classify the infill material which may, in accordance with the Waste Management Act 1996 (as amended), be required to be disposed of to landfill; iv. The basic characterisation laboratory results obtained shall be further analysed using the Haz Waste Online Tool to determine the suitability of the material for infill and to determine classification; v. If required, recommendations for the lawful remediation of the lands shall be proposed; and vi. A further assessment carried out by an Environmental Consultant shall be completed to determine the suitability of the proposed surface water disposal method taking into account the possibility for groundwater contamination arising from the infilled material. Alternative proposal shall be submitted if required. The planner dealing with this application is Ben Clerkin
