Dear Sir/Madam,
We wish to make an observation in relation to the above planning application.
The proposed development raises serious concerns regarding the access arrangements. The lane
providing access is owned by Drumsnatt Parish Church, and it is our understanding that the applicant
does not own this lane.
The planning application proposes to use the existing entrance and access arrangements, which rely
on this privately owned church property. We are concerned that the application has not demonstrated
that the applicant has the legal right to use or alter the access over land owned by the church.
We respectfully request that Monaghan County Council consider:
* Whether the proposed development relies on access over land not owned or controlled by the
applicant.
* Whether the applicant has the necessary legal entitlement to use the church -owned lane for the
proposed development.
* Whether granting permission could prejudice the rights of the church as the owner of the lane.
* Whether the planning authority is satisfied that safe and lawful access exists independently of any
disputed private rights.
We ask that these concerns be fully considered before any decision is made. If permission is granted,
we request that no permission be interpreted as conferring any right to use or interfere with land
owned by Drumsnatt Parish Church
