Re: Planning Application 25/60450 - Permission to erect a single-storey dwelling house, packaged
wastewater treatment system/mounded polishing filter, new vehicular entrance, hard/soft landscaping, and
associated site works situated at Killatten, Scotstown, Co. Monaghan..,
Dear Sir/Madam,
In respect of the above project and on behalf of our client Aine Mullen, please find below clarifications details
and attached further information for your necessary information purposes.
Item 1
The proposed dwelling is being sought under the landowner provision contained within Section 15.9.6(a) of the
Development Plan, which permits a relaxation of the ribbon development policy where:
"Planning permission is sought on the grounds of meeting the housing needs of a landowner or a member of
his/her immediate family where no other suitable site is available on the entire landholding."
In support of this provision, the following information is submitted:
a) Landowner Status
The applicant, Ms. Aine Catherine Mullen, is the registered owner of Killattin, Scotstown. The
folio confirms ownership of approximately 7.3349 hectares (18.1 acres), thereby exceeding the minimum 4-
hectare landholding requirement contained within Section 15.9.6.
b) Duration of Ownership
confirms that the lands have been in the ownership of Ms. Mullen since 2 June 2000, substantially
exceeding the minimum ownership period of five years required under the Development Plan.
c) Verification of Entire Landholding
A solicitor's letter from Caldwell Ritchie Berry Solicitors has been submitted confirming that all lands contained
within is within the ownership of the applicant.
d) Availability of Alternative Sites
The applicant confirms that no alternative suitable site exists within Having considered the
entirety of the landholding, the proposed site was selected as it best satisfies the site selection criteria of Section
15.9.2 (Site Selection and Design Guidelines) of the Monaghan County Development Plan 2025–2031. The site
benefits from existing shelter, favourable topography, established roadside and natural boundaries, and a
suitable degree of enclosure, allowing the dwelling to integrate into the surrounding landscape with minimal
visual impact. RECEIVED: 13/07/2026
The site also minimises the removal of existing roadside hedgerows required to achieve sight visibility splays and
benefits from a natural eastern boundary which will help soften and screen the development. Accordingly, the
proposed location represents the most appropriate and sustainable site within the landholding and the only
suitable site available to meet the housing needs of the landowner in accordance with Section 15.9.6 and Policy
RIDP 1 of MCDP.
e) Compliance with Section 15.9.6
As the applicant:
• owns in excess of 4 hectares,
• has owned the lands for considerably longer than five years,
• has provided solicitor verification of the entire landholding, and
• confirms that no alternative suitable site exists within the folio,
Having regard to the information submitted, it is considered that the proposal complies with the landowner
provisions of Section 15.9.6 and therefore satisfies the requirements of Policy RIDP 1 of the Monaghan County
Development Plan 2025–2031 notwithstanding that the proposal would constitute the fifth dwelling within the
identified 250-metre road frontage.
Item 2
A revised Site Layout Plan is enclosed demonstrating a clear and unobstructed visibility splay of 70m x 2.4m x
1.05m at the proposed entrance onto the Local Primary Road. The visibility splays are shown from the centre of
the entrance, measured 2.4m from the road edge, with sightlines taken at a height of 1.05m to 2.0m above
ground level to the nearest road edge in both directions. The plan illustrates all necessary site works, including
hedge/tree trimming or removal required to achieve and maintain the sight distances. All required visibility
splays are achievable within the applicant’s ownership; therefore, no Legal Agreements with adjoining
landowners are required.
Item 3
In response, the front elevation has been revised to address concerns regarding the extent and treatment of
glazing. The previously proposed expansive glazed opening has been reduced and sub-divided through the
introduction of a masonry pillar, thereby breaking up the glazing and providing a clear vertical emphasis
consistent with traditional rural vernacular proportions.
The revised design results in:
• Reduced horizontal emphasis to the front elevation,
• Improved articulation and rhythm in the façade, and
• Compliance with Policy RSDP 1 and the design guidance set out in Table 15.3.
Revised drawings reflecting these changes are submitted for the Planning Authority’s consideration.
