Monaghan H 18W422 20 July 2026 An Coimisiun Pleanala 64 Marlborough Street Dublin 1 D01 V902 Third Party Appeal under Section 37 of the Planning and Development Act 2000 (as amended) Planning Application Ref: 26/60067 1 Gola Eggs Ltd. I Gola English, Scotstown, Co. Monaghan Decision: Conditional Grant of Permission I Monaghan County Council 1 26 June 2026 A Chara, We write to lodge a formal third -party appeal against the decision of Monaghan County Council to grant conditional planning permission for the above development, issued on 26 June 2026. We are neighbouring landowners and residents at Drumloo, Scotstown, directly adjacent to the application site, and we submitted an observation at planning application stage (received 5 April 2026), a copy of the acknowledgement of which is enclosed. We submit that the decision to grant permission was wrong in law and in fact, and that An Coimisiun Pleanala should refuse permission for this development or, in the alternative, impose substantially more robust conditions than those attached by the planning authority. 1. The Development and Its Proximity to Our Home and Land The proposed development consists of a new large-scale poultry house (gross floor area 3,029.40 sq m) for 30,000 hens, a manure loading and storage building, meal storage bins, soiled water tanks, and associated site works. Combined with the existing poultry house on the same site (9,000 birds), total bird numbers at this farm would reach 39,000 - more than four times the current permitted level. Our current family home is approximately 150 metres from the proposed new poultry house. Our old family dwelling house - owned by Rosaleen McQuaid and currently in the process of being restored under the Vacant Property Refurbishment Grant scheme, with a positive preliminary indication of approximately €120,000 in funding received - is approximately 105 metres from the proposed new poultry house. Our land boundary is approximately 95 metres from the proposed structure. These are not large distances. A 30,000 -bird industrial barn, with its manure loading and storage area positioned on the side of the site directly facing our home and our old dwelling, with the prevailing wind blowing from the development towards our property, will have a direct, severe, and continuous impact on our family. 2. Odour: Severe and Persistent Impact on Residential Amenity A facility housing 39,000 hens will produce an enormous and continuous volume of manure. The smell from a poultry operation of this scale — and particularly from the manure loading and storage area, which is positioned on the side of the site facing our property at a distance of approximately 105 metres from our old dwelling and 150 metres from our family home - will be severe, penetrating, and persistent. It will be present on warm days, in wet weather, during loading and unloading operations, and at all times the facility is in use, which is year- round. The planning authority has attached no condition whatsoever addressing odour. There is no odour management plan, no buffer distance requirement, no requirement for enclosed loading at all times, and no monitoring or enforcement regime. This is a fundamental failure of the decision. We ask An Coimisiun Pleanala to require a detailed, independently verified odour impact assessment before any permission could be considered. 3. Flies: An Already Serious Problem That Will Become Unbearable There is already a high fly density in this area. The establishment of a barn housing 30,000 hens, with a manure storage and loading facility facing our property at approximately 95 metres from our land boundary, will make this problem drastically and permanently worse. Poultry manure is among the most significant fly -breeding materials in agricultural use. Flies will breed in the manure store, travel to our home, enter our house, contaminate food, and present a genuine health risk to our family, including children. No condition requires fly monitoring, fly control measures, or any management plan. Even with weekly manure removal - which is not independently enforced under any of the eight conditions attached to this permission - the manure store will be in active use between collections, positioned directly facing our property. This risk has not been assessed or addressed at any point in the planning process. 4. Noise: 39,000 Hens, Industrial Machinery, and Constant HGV Movements A barn housing 30,000 hens, with multi -tier aviary systems, continuous ventilation fans, manure conveyor belts, and regular HGV movements for feed delivery, egg collection, live bird transport, dead bird collection, and weekly manure removal, will generate substantial and continuous noise. Ventilation systems in large poultry barns of this type run continuously, day and night. No noise impact assessment has been carried out, and no condition addresses noise impact on our family home. 5. Devaluation of Our Property and Land The establishment of a 39,000 -bird industrial poultry facility, with its associated manure loading area, heavy vehicle movements, odour, flies, and noise, at a distance of 150 metres from our family home and 105 metres from our old dwelling, will cause a significant and lasting devaluation of our property and land. No reasonable purchaser would pay market value for a family home or a dwelling for restoration that sits 150 metres downwind of a facility of this scale. This devaluation is a direct and measurable harm to our family's financial interests and is a recognised material planning consideration that has not been addressed in the planning authority's decision. We also wish to place on record that, prior to the grant of this permission, the applicant made a remark directly to Michael McQuaid which stated, in words to the effect of: "sure what are you worried about me putting up the hen house for — sure you'll be selling the property." We note this as it suggests the applicant had a prior expectation that this development would result in the McQuaid family vacating their home and land. We submit this is relevant to the question of residential amenity impact and to the weight An Coimisiun Pleanala should give to the applicant's characterisation of relations between the parties. 6. Visual Impact: Scale, the Old Dwelling House, and Blocking of Views The proposed new poultry house has a gross floor area of 3,029.40 sq m and a ridge height of approximately 6.875 metres. It is a large, industrial -scale metal structure that will dominate this rural landscape. The removal of all boundary trees by the applicant has eliminated the natural screening that previously existed. Replacement planting — small saplings at 0.6 to 4.5 metres at planting — will take ten to fifteen years to provide any meaningful screening. Our family will look directly onto this structure every day. Our old family dwelling house, located 105 metres from the proposed development and clearly visible from the public road, is actively being pursued for restoration under the Vacant Property Refurbishment Grant scheme. The proposed development will directly overshadow and visually overwhelm it, destroying its rural setting entirely. We are also pursuing the restoration of the old house and have received a positive preliminary indication of approximately €120,000 in grant funding. Granting permission for a development of this scale in such proximity is fundamentally inconsistent with national and local policy supporting the return of vacant rural dwellings to residential use. 7. Condition 5 Cannot Be Complied With - The Trees Were Already Removed Before the Application Was Made Condition 5 requires that "the existing trees and hedgerows bounding the site boundary shall be permanently retained." We must draw An Coimisiun Pleanala's attention to the fact that the applicant removed the boundary trees before the planning application was made. The condition is therefore incapable of being complied with from the outset. Michael McQuaid was informed by the applicant that the trees were going to be cut down, but this was before any planning application existed. There was no discussion of the removal in any planning context, and Michael McQuaid had no reason to connect it to a future planning application. No independent tree surgeon's report or arboricultural assessment was obtained to justify the removal. The applicant's agent has claimed all trees were affected by ash dieback and posed a risk to power lines but has produced no expert evidence to support this. Replacement saplings are not a substitute for established mature trees. The applicant has, by their own actions prior to lodging the application, made a key mitigation condition unenforceable. 8. Water Quality: The Derrylusk Stream and the Water Framework Directive The Derrylusk Stream runs approximately 20 metres east of the proposed development. Both the Derrylusk Stream and the Magherarney River are classified by the EPA as having poor ecological status - acknowledged in the applicant's own Natura Impact Statement. Under the Water Framework Directive (2000/60/EC) and the CJEU judgment in Case C- 461/13 (Weser), planning permission must be refused where a development may cause any deterioration in the status of a waterbody already classified as poor. A 39,000 -bird poultry facility sits 20 metres from this stream. The conditions attached rely entirely on applicant self -compliance. There is no independent water quality monitoring, no baseline sampling requirement, and no mechanism to detect gradual deterioration. An Taisce raised this in detail in their submission of 8 April 2026. No assessment against Article 4 of the WFD appears to have been carried out. 9. No Sub -threshold EIA Screening Was Carried Out The development brings total bird numbers to 39,000, just 1,000 below the mandatory EIA threshold under Schedule 5, Part 2(1)(e)(i) of the Planning and Development Regulations 2001. A sub -threshold EIA screening was required and does not appear to have been carried out. An Taisce raised this in April 2026. Given the proximity of poor -status watercourses, the presence of Natura 2000 sites within the zone of influence, and the scale of the intensification, we submit that An Coimisiun Pleanala cannot properly determine this appeal without first carrying out or requiring an EIA screening determination. 10. Traffic and Road Infrastructure The site is served by a narrow, third-class rural road in very poor condition. The development will generate substantial additional HGV movements including weekly manure removal. No Traffic Impact Assessment or Road Safety Audit was carried out or required by condition, despite An Taisce calling for one in April 2026. 11. The Public Notice Was Defective The site notice was displayed on white paper, not the prescribed yellow background. It was not positioned at or near the principal entrance to the development site but approximately 200-500 metres away. We have photographic evidence and can provide it on request. 12. The Applicant Misrepresented His Dealings with Michael McQuaid The applicant's agent (CLW Environmental Planners) stated in their Further Information response that landscaping proposals had been "discussed/agreed with the author" of the third -party submission. This is factually incorrect in two distinct respects. First, the boundary trees — which form the basis of the landscaping discussion — were removed before the planning application was made. There were no discussions between Michael McQuaid and the applicant about trees in any planning context, at any time. Second, no agreement of any kind was reached on any matter. Michael McQuaid did not sign or consent to anything. An Coimisiun Pleanala is asked to give no weight to the applicant's characterisation of relations between the parties in the absence of any written evidence of agreement. Conclusion and Relief Sought We respectfully request that An Coimisiun Pleanala: • Refuse planning permission for this development; or • In the alternative, require a full Environmental Impact Assessment Report before determining the appeal; • Require an independent odour impact assessment; • Require an independent noise impact assessment; • Require a Traffic Impact Assessment and Road Safety Audit; • Carry out a full assessment of the development against Article 4 of the Water Framework Directive; • Require an independent arboricultural assessment in respect of the trees already removed by the applicant before the application was made; and • Give no weight to any claim by the applicant that an agreement was reached with us, in the absence of any written evidence to that effect. We are available to provide photographic evidence, further documentation, or oral evidence as required. Is mise le meas, Michael McQuaid & Rosaleen McQuaid Drumloo, Scotstown, Co.
