1. The site of the proposed development is within a portion of the site area for a dwelling house granted
permission under planning file number 02/273. The site area also contains an existing laneway and
access onto the public road that were not permitted under planning file number 02/273, and are
considered to be unauthorised development and in contravention of Condition 4 of planning file
number 02/273.
To permit the proposed development would materially contravene a condition attached to an existing
permission for development and would be contrary to the proper planning and sustainable
development of the area.
2. Section 15.9.1 (Rural Character) and Policy RCP 1 of the Monaghan County Development Plan 2025-
2031 seek to ensure that new rural housing does not further erode the rural character of an area.
Having regard to the nature of the site as a residual roadside plot arising from the subdivision of
roadside lands for residential development, the Planning Authority considers that the proposal would
represent an incongruous form of development which would fail to respect and would further erode
the rural character of the area.
Accordingly, the development would, if permitted, be contrary to Section 15.9.1 (Rural Character) and
Policy RCP 1 of the Monaghan County Development Plan 2025-2031 and be contrary to the proper
planning and sustainable development of the area.
