Appropriate Assessment
Under Article 6(3) of the EU Habitats Directive and Regulation 30 of SI no. 94/1997
“European Communities (Natural Habitats) Regulations” (1997) any plan or project which
has the potential to significantly impact on the integrity of a Natura 2000 site (i.e. an SAC or
SPA) must be subject to an Appropriate Assessment. This requirement is also detailed under
Section 177(U) of the Planning and Development Acts (2000-2010).
The site is removed from any Natura 2000 sites and there are no significant pathway
connectors in the vicinity.
Having regard to the context and the development as proposed, and the activities associated
with the development proposal both during and post construction works, it is taken that it is
not necessary for an Appropriate Assessment to be carried out in relation to this
development.
Planning Assessment
The following sections, objectives, policies, etc, contained in the County Development Plan
2025-2031 pertain:
▪ It is general Council policy to support the provision of additional childcare places in
suitable locations such as this (Section 5.9 and Policy CFP 3).
▪ Re the assessment criteria for childcare facilities, outlined within Section 15.8.15, it is
noted that:
➢ The site is long-established and the dedicated external play space/area would be
enlarged.
➢ Circulation, pick up and set down details are established.
➢ The proposal incorporates an increase in on-site parking provision (nine additional
spaces), which is considered adequate to serve the development.
➢ Whilst the operational details (daily, weekly and seasonal) are unconfirmed, it is
taken that these are suitably established.
▪ Re design (Policy DTVP 1), the proposed buildings, including the existing single storey
modular canteen, can be accommodated spatially and would not materially alter the
character of the site.
▪ No residential amenity concerns arise (Section 15.22.2).
Other Matters
▪ Whilst the EHO has requested further details regarding wastewater treatment capacity,
no evidence has been submitted to indicate that the existing system is inadequate.
Having regard to the nature and scale of the proposed development, it is reasonably
considered that the continued satisfactory operation of the existing wastewater
treatment system can be adequately safeguarded by condition.
▪ A completed water protection plan checklist has not been submitted.
Conclusions
A conditional grant of permission is recommended.
Having regard to the established nature of the use, the community childcare function of the
facility, the charitable status of the applicant and the limited scale of the proposed
extension, it is considered reasonable that development contributions shall not be applied in
this instance.
Recommendation
That Permission is GRANTED subject to the following conditions:
1. Prior to the commencement of development, the developer shall submit:
(i) Written confirmation from a suitably qualified person that the existing wastewater
treatment system has sufficient capacity to accommodate the proposed development.
Where such confirmation cannot be provided, the permitted extension shall not be first
occupied or brought into use unless and until any necessary planning permission relating to
wastewater treatment requirements has been obtained; and
(ii) a completed Water Protection Plan Checklist.
Reason: In the interests of public health and environmental protection.
2. (a) Developer shall ensure that adequate measures are in place for the construction phase
to ensure there is no discharge of polluting matter/sediment laden waters to any
watercourse or drains.
(b) Any construction and demolition waste shall be recovered/disposed of by a registered,
qualified waste contractor in accordance with the Waste Management Act 1996 (as
amended) and shall incorporate any hazardous waste, including asbestos.
Reason: In the interest of environmental protection.
3. Development within the site in respect of potable water services shall be to standards as
required by Uisce Éireann.
Reason: In the interests of orderly development, public health and securing a satisfactory
standard of development.
4. No signs, flags, logos, other advertising material or illumination shall be erected within the
site or along the site boundary without prior permission from the Planning Authority.
Reason: In the interest of visual amenity.
5. The development shall be carried out strictly in accordance with the plans and documents
submitted on the 17/07/2026, except as may otherwise be required in order to comply with
the above conditions.
Reason: In the interest of proper planning and sustainable development.
