It should be noted that you will be required to give notice in an approved newspaper under article 35(1)(a) and erect a site notice in accordance with Article 35 (1)(b) of the Planning and Development Regulations 2001 (as amended) if the further information received is considered to contain significant additional data. Yours faithfully, __________________________ ADMINISTRATIVE OFFICER pp 26/60305 Peter McGrane Tiravera, Glaslough, Monaghan. ADDITIONAL INFORMATION 1. The Planning Authority notes that the proposed development includes the creation/retention of an existing entrance and the provision of visibility splays as illustrated in the submitted site layout drawing MGA_26_130PL101, however this aspect of the proposal has not been referenced in the development description. As such, the proposed development description is considered to be inaccurate. Notwithstanding the planning history for the site and the established nature of the existing entrance, the applicant is requested to provide the following details/documentation, in accordance with Article 35 of the Planning and Development Regulations 2001 (as amended): a) A revised development description to include reference to the proposed entrance/access. b) Revise the site notice indicating ‘Significant Further Information/Revised Plans’, as appropriate and erect a revised site notice on site. c) Publish a revised press notice indicating ‘Significant Further Information/Revised Plans’, as appropriate and include the revised development description. d) Submit a copy of the revised site notice and revised press notice to the Planning Authority 2. Section 15.23.1 ‘Visibility Splays Agreement’ of the Monaghan County Development Plan 2025-2031 notes it is Council policy to only grant planning permission for development involving the creation of an access and/or the provision of visibility splays, where the applicant is able to demonstrate control or the reasonable prospect of acquiring control of any land required for the provision of any access and/or visibility splays. Proposals requiring works on third party lands must be accompanied by a written legal agreement, in accordance with Appendix 13, signed by all parties, and witnessed by a Solicitor. The Planning Authority notes that the proposed visibility splay to the east of the proposed entrance traverses third party lands, however, no legal agreement has been provided with the applciation. Having regard to same, the applicant is requested to submit the following information, in the interests of road safety; (i) A revised site layout plan (1:500 scale) indicating how clear and unobstructed visibility splays of 50 metres can be achieved at the proposed entry/exit point onto the adjoining public road. The required visibility splays should be provided from a point in the centre of the entrance, 2.4 metres from the road edge at a height of 1.05 metre to 2.0 metres above ground level to an object height of 1.05 metres to 2.0 metres above ground level in both directions. The submitted revised site layout plan should demonstrate all necessary site work, including the extent of the front boundary hedge and trees which would be required to be removed/trimmed, re-grading of side banks etc to achieve the required sight distances. (ii) Where the sight distances are not achievable within the applicant’s ownership, the applicant should submit legal agreements with adjoining landowners giving their consent for all necessary works to facilitate the required 50 metre sight distances, including removal/trimming of hedgerow/hedges, re-grading of side banks etc. The applicant should note that legal agreements should be submitted using the Appendix 13 template ‘Form of Agreement in respect of forward and rear visibility’ as contained in the Monaghan County Development Plan 2025-2031. 3. Planning Authority notes that the submitted site assessment report is a replica of a site assessment report submitted with concurrent application on neighbouring lands ( see planning reference number 26/60304). No site assessment has therefore been carried out and/or submitted in respect of the development proposed. The applicant is therefore requested to submit a full site assessment report, carried out in accordance with the requirements of the Environmental Protection Agency (EPA) ‘Code of Practice Domestic Waste Water Treatment Systems (Population Equivalent <=10) 2021’ and in accordance with Section 15.22.5 ‘On-Site Wastewater Treatment Systems’ of the Monaghan County Development Plan 2025-2031.
