No. 8277204J Planning Department, Monaghan County Council, County Offices, The Glen, Monaghan. 9th September 2026 RE: Planning application for Trevor McBride. Development Address ~ Shanemullagh, Clontibret, Co. Monaghan. Your Ref: 26/60209 Dear Sir/Madame I refer to the planning application for development on an existing poultry farm, made on behalf of Mr. Trevor McBride and your subsequent correspondence in relation to same dated 10th July last. Please find detailed below the response to the issues raised. 1. The Applicant has submitted a Site Layout Plan indicates that the application site will be accessed of the Local Primary Road via an existing access. It would appear that the maintenance of visibility splays (cutting back of hedgerows) would be required in both directions, to ensure the 50m visibility is achievable, and as such, Appendix 13 Legal Agreements would be required, specifically in the south - eastern direction. In this regard, the applicant is requested: Where the sight distances are not achievable within the applicant’s ownership, the applicant should submit Legal Agreements with adjoining landowners giving their consent to allow re -locating of obstruction impeding on the visibility splays, removal of their hedgerow and hedges trimmed regularly to provide the required sight distance. The Legal Agreement and accompanying Maps shall be signed by the landowner, the applicant and witnessed by a Solicitor in accordance with exact wording of Appendix 13 of Monaghan County Development Plan 2025-2031. Please refer to updated site plan confirming 50m in each direction within control of applicant. 2. The Planning Authority note, following site inspection, that there are two vehicular openings along the Local Tertiary Road from which the site can be accessed. From the submitted Site Layout Plan, the applicant intends to use only the north -western opening. In this regard, and in the interest of road safety, the applicant is requested to permanently close up the opening to the south-east of the proposed access point. Please refer to updated site plan confirming that only one entrance will be used. Furthermore, an electric sliding gate (type as previously agreed with Monaghan Co. Co. under Planning Ref. 24/60058.) will be installed and operated as detailed on the enclosed drawings. RECEIVED: 09/09/2026 Phone: 049-4371447/9 Fax: 049-4371451 E-mail: info@clw.ie The Mews, 23 Farnham Street, Cavan, Co. Cavan CLW Environmental Planners Ltd. Directors: S. Clarke, O. Leddy B.Agr.Sc., P. Fay B.Agr.Sc. V.A.T. Reg. No. 8277204J 3. The proposed development is considered insufficient in terms of the environmental information provided. In this regard, the applicant is requested to submit: a) A revised site layout plan (1:500) indicating how it is proposed to prevent internal surface water from the entrance flowing onto the public road, as well as demonstrating the following; - All proposed surface/storm water drainage systems (outlined in blue). - The directional flow of all surface water pipelines. - Proposed nature-based solutions for surface water. - All associated discharge points and outfalls. - All proposed foul water drainage systems (outlined in red). - All soiled water storage tanks including volumes and dimensions of same. Please refer to updated site plan addressing issues raised above. b) Details of proposed manure storage facilities demonstrating 26 weeks storage An on-site manure store has previously been approved under Planning Ref. 25/60058. This store can accommodate 515-775 tonnes of poultry manure (@ 2-3m deep). As detailed in the EIAR the annual production is anticipated to be 670 tonnes. (While m3 produced and removed from the house on the automatic belt system, will seem higher, same will compact in storage.) In relation to storage the manure store is construction / planned to be constructed before the end of this year (and in any event prior to the new house being constructed). As detailed below, and as per SI 588 of 2025, the 26 weeks manure storage is not required on -site once there is a DAFM registered contractor removing the manure from the farm, and confirmation from the contractor has previously been submitted. Reduced storage capacity in certain circumstances 14. (1) The capacity of facilities for the storage of livestock manure on a holding may, to such an extent as is justified in the particular circumstances of the holding, be less than the capacity specified in Article 10, 11, 12 or 13, as appropriate, in the case of a holding where— (a) the occupier of the holding has a written contract providing exclusive access to adequate alternative storage capacity located outside the holding, (b) the occupier has a written contract for access to a treatment facility for livestock manure, or (c) the occupier has a written contract for the transfer of the manure to a person registered and permitted under and in accordance with the European Union (Animal By -products Regulations 2014 (S.I. No. 187 of 2014) and the Transmissible Spongiform Encephalopathies Regulations 2015 (S.I. No. 532 of 2015) to undertake the transport of manure.
