Please refer to Water Protection Plan Checklist enclosed. b) Clarification on what buildings on the farmyard are used to house pigs. All buildings identified on site are for the housing of pigs, as per screen shot below and as detailed on the plans as submitted. Please refer to correspondence below from applicants Vet. Please also see extract from S141 detailing space requirements per pig in line with DAFM requirements. Necessary space to comply with DAFM Specifications; • 150 Weaner pigs (<30 kg) @ 0.36 m2 = 54 m2 • 450 Production pigs* (30 kg – 110 kg) @ 0.95m2 = 427.5 m2. (Alternatively the farm may operate as 500 production pigs @ 0.95m2 = 475m2 floor space minimum. Actual pig type and numbers within the parameters above relies on the breeding farm and the weight of pigs available/supplied.) *Production pig includes all pigs over 30kg (incl. weaners>30 kg, growers and finishers) Total floor apace required = 475-481.5 m2. Available Area = 486 m2 (internal pig pen area only, as per above drawings) Therefore the development complies with DAFM requirements / Specifications and animal welfare requirements. This shall be prepared by a suitably qualified person and shall take into account the EPA Air guidance Note (AG5). The assessment shall include recommendations for odour abatement where required using the best practicable means for pig housing to limit and, if possible, to prevent an emission in such a quantity, or in such a manner, as to be a nuisance. Please refer to Odour Management Plan attached. This development has been assessed uising the E.P.A.’s own dedicated tool for Intensive agriculture. Same was published in 2022, and while not alone being specific to pig farm assessments same was published after AG5, and is therefore more up to date and more suited to the development at hand. Instruction note and screening tool for the assessment of odour emissions from Intensive Agriculture pig installations Summary: This instruction note provides a methodology to applicants on how to predict and assess odour emissions from intensive agriculture pig rearing installations. The methodology includes an excel based screening tool, which can be used in conjunction with the instruction note. The screening tool is available to download on this page. Please note that Excel version 2007 or higher is required to run the tool without loss of functionality. e) Applicant to confirm there is no other livestock associated with this holding or herd number attached to this farmyard. If there is a bovine/other enterprise along with the pig unit a nutrient management plan (farmer full) for the holding is to be submitted. This NMP assessment should include maps of lands with parcel ID, up to date soil sampling results and current stocking rate for lands in question. The plan shall be prepared by a suitably qualified agricultural advisor. This farm operates independently of any other farming activity and under a separate herd number specific to pig production that does not provide for any bovine livestock. The applicant/applicants family also operate a bovine farming activity, (summer grazing only with no over wintering of bovine livestock) however same operates independently of this activity. In order to address Monaghan Co. Co. concerns a N and P statement and area aid maps of same are submitted as confidential information. Same confirms that the bovine farming activities operate at a low stocking rate of 34 kg organic N/Ha. Furthermore the Record 3 submissions (also submitted as confidential information) also demonstrate compliance of the activity under consideration with S.I. 588 of 2025. If spreadlands are in County Monaghan BPS maps of lands are to be submitted. Maps shall clearly show buffer zones to be maintained. Information submitted shall be sufficient to demonstrate compliance with the European Communities (Good Agricultural Practice for Protection of Waters) Regulations, 2022. Please see below an extract from a recent An Coimisium PLeanala report (PL15.320010) relating to the development of another farm (poultry in this case); “For the purposes of clarity, the Commission should note that land spreading does not form part of this application and such process is regulated under the European Union (Good Agricultural Practice for Protection of Waters) Regulations 2022 S.I. No. 113/2 022 (the GAP Regulations), not by An Coimisiún Pleanála. The development under consideration in this instance is the poultry farming operation; similar to the EPA, the statutory power of An Coimisiún Pleanála does not extend to the authorisation of the possible end-use of the poultry litter or wash water generated, which is governed by other statute. The GAP regulations are the appropriate mitigation for such effects.” The response to the issues raised has to be considered in light of the above and the appropriate and applicable legislation in relation to the protection of waters and the management of organic fertilisers (incl. soiled water) and farming activities. The applicant has demonstrated (via the submission a copy of his Record 3 Submission – submitted as Confidential Information) that the organic fertiliser produced on this farm has been appropriately recorded in accordance with S.I. 588 of 2025, however thereafter it must be acknowledged that the responsibility for its use rests with the farmers utilizing same as a fertiliser source, and while in some instances this may be the applicant, or the applicant’s family, it may not always be. This submission contains the herd numbers of the farmers. S.I. 588 of 2055 provides for the appropriate sharing of information between Monaghan Co.Co. and DAFM as follows (and these regulations do not require the applicant to hold BPS maps of third party farmers lands), Compliance with Data Protection Acts 32. The provision of information by a local authority, the Agency or the Minister for Agriculture, Food and the Marine in accordance with Article 28, 30 or 31 of these Regulations shall not be a breach of the Data Protection Acts, 1988, 2003 and 2018. No. 8277204J Based on an occupancy rate of 500 finisher pigs, @ 0.024m3/ production pig/annum as per S.I. 588 of 2025 annual organic fertiliser production would equal c. 600-650 m3/annum, assuming maximum occupancy for the entire 52 weeks. (Alternative stock numbers of 150 weaners and 450 production pigs would not alter this organic fertiliser production.) Record 3 details as submitted detail exports of 610 m3, which would represent the total organic fertiliser produced. g) A revised site drainage plan which clearly shows the following: i. Clean (blue) and soiled (red) water flow paths, ii. The discharge point(s) of clean waters from the yard, and iii. Location of cattle crush for retention. Same is to be addressed under Separate Cover 2. The Planning Authority notes that the applicant seeks to use an existing access onto the public road to serve the proposed development. Accordingly it is considered there would be intensification of use of an existing access. The site layout plan submitted is unclear with regards demonstrating adequate access details. In this regard, the applicant is requested to submit: a) A revised site layout plan (1:500 scale) indicating how a clear and unobstructed visibility splay of 70m can be achieved at the proposed entry/exit point onto the Local Secondary road. The required visibility splays should be provided from a point in the centre of the entrance, 2.4 metres from the road edge at a height of 1.05 metre to 2.0 metres above ground level. Sight distances to be measures to the nearest road edge in both directions. The submitted revised site layout plan should demonstrate all necessary site work, including the extent of any front boundary hedge and trees which would be required to be removed/trimmed, re-grading of side banks etc to achieve the required sight distances. The road edge boundaries should be clearly delineated. b) The area within the visibility splays shall be cleared to provide a level surface no higher than 250mm above the level of the adjoining carriageway and shall be retained and kept clear thereafter. c) Where the sight distances are not achievable within the applicant’s ownership, the applicant should submit legal agreements with adjoining landowners giving their consent for all necessary works to facilitate the required 70m sight distances, including removal/trimming of hedgerow/hedges, re-grading of side banks etc. The Applicant should note that legal agreements should be submitted using the Appendix 13 template as contained in the Monaghan County Development Plan 2025 -2031. The Planning Authority have serious concerns with regards to adverse smell impacts to dwellings in the surrounding area. The applicant shall provide information on robust odour mitigation and management measures. Introduction The site of the existing farm, and pig houses, are located in an agricultural hinterland where typical levels of farm activity are existing/to be found and expected. The existing farm includes bovine handling facilities and porcine accommodation. 2. Pig Farm Odour – Odour associated with pig farming enterprises may arise from two situations: * The pig farm site, and, * The manure spreading operation. The pig farm is located in an entirely agricultural hinterland where typical levels of farm odour are to be found and expected. This odour arises from farmyards and lands during the day to day operations such as silage feeding, manure agitation and manure spreading. The existing farm development using the best available practices, will operate without a significant effect on the environment and the applicant/farm management will strive to minimise all potential environmental impacts. Well maintained, properly ventilated pig farms with modern manure management systems will minimise any potential adverse odour impact and will be practically odour free outside the confines of the site/immediate area. Transient increases in odour emissions may be associated with manure removal from the site. While there are residences in relatively close proximity to the farm, incl. the applicant’s family, there are no odour sensitive locations likely to be affected by the proposed development (as detailed hereafter). This development will have no significant adverse affect on climate. This existing farm / site of the proposed development, operates in a rural agricultural environment, and the farm will cause no nuisance. The Closest 3rd party residence is located c. 85m from the centre of the proposed development. The farming activities at 500-600 pigs is a relatively modest (if not small) activity providing a part-time income for the applicant. The proposed activities and stock numbers were modelled to arrive at the existing baseline for the site. No. 8277204J Fig 3 Odur Emission factors taken from E.P.A. “Instruction note for the assessment of odour emissions from Intensive Agriculture pig installations” In line with this guidance the acceptable odour levels specific to new and existing developments are as follows: For the purposes of this instructional note, the acceptable odour level s specific to intensive agriculture are as follows: (REF. EPA Instruction note Pg. 5) • 3.0 OUE/m3 for new pig-production units; • 5.0 OUE/m3 for existing pig-production units (includes sites licensed by the EPA between 2001 and 15th February 2017 only); and • 6.0 OUE/m3 for existing pig-production units (includes sites licensed by the EPA prior to 2001 and not reviewed since this date only). The applicability of the above levels will be at odour-sensitive locations only. • The table below details the distance from the centre of the existing pig farm required to achieve the required thresholds, based on the proposed stock numbers, housing, manure storage and operating practices. • Moderate dispersion is used as the farm operates a fan ventilation system. • As can be seen the 5 OUE/m3 threshold (applicable to existing farms is achieved at c. 40.1 m from the centre of the farm (versus the closest 3rd party residence at 86.74m), with the 3 OUE/m3 threshold (applicable to new farms is achieved at c. 85.3 m (The centre of the farm is used as per the guidance requirements). • It is important to note that the E.P.A. Guidance is designed as a screening tool to, and as expressly detailed in the guidance “The screening tool enables the user to generate a worst-case odour impact”. No. 8277204J Scenario 2: Data Entry (Mitigation – 30% odour reduction due to the use of low protein diets as currently used on the farm.) As per Section 4.2 of the aforementioned E.P.A. Guidance – 4.2. Recommended Levels of Mitigation 4.2.1. Manipulating Dietary Protein & Supplements Manipulating animal feed by reducing dietary protein will reduce the amount of unused protein that passes through a pig’s digestive system. Fewer precursor compounds present in the slurry will reduce potential odour. For detailed modelling, it would be reasonable to apply a reduction factor of 10% on the basis of a reduction of 1% crude protein in the diet. The maximum reduction factor that can be applied is 30% linked to a reduction of 3% crude protein in the diet. The current farm operates on a low protein diet with all diets with a 3% reduction in Crude Protein levels thus the maximum 30% reduction has been applied. Furthermore as previously detailed and outlined this screening tool is designed to be conservative and present a worst case scenario. Guidance. As can be seen from the above the development as existing complied with the E.P.A. thresholds when assessed in line with E.P.A. Guidance. Not only does the existing activity comply with the standards for an existing farm, it also complies with the standards for a new farm, without any additional mitigation, thus ensuring that this farm will not have an adverse impact. Furthermore as this farm is, • already implementing low protein diets (with a significant impact reduction as calculated above), • operating a mechanical ventilation system, • located north of the closest receptors with the predominant wind from the south east, thus blowing any potential odours away form the closest dwellings, and as the E.P.A. guidance is specifically designed to to be conservative and present a worst case scenario, if can be determined that this relatively small scale agricultural activity under consideration will not cause an adverse impact in then local area. Notwithstanding same the following Odour Management Plan will be implemented. No. 8277204J 3 Odour Management Programme 3.1 On-Site Proposed Odour Management Programme Manure odours may be reduced by preventing their production and by preventing their emission. Several odour-control techniques used in industry are technically feasible for use in pig production, but are prohibitively expensive. The proposed odour management programme will revolve primarily around site management activities. These management activities are listed below: 1. Hygiene/Washing Routines Every surface covered with manure, spoiled/unused feed and/or dust is a possible and probable source of odour. It will be ensured that all houses are washed regularly with high-pressure washers in order to ensure that all surfaces are free from dust, faec es and/or spoiled feed. As previously stated all of these can lead to extra odours being produced. These pigs are moved in an all in/all out production system. All housing on-site is to be well maintained and has been completed so as to be as labour and input efficient as possible, while at the same time maximizing performance, minimizing emissions and ensuring that the houses are kept clean at all times. The internal finishes help ensure that they are easily cleaned between batches. An appropriate Hygiene/Washing protocol will be implemented on the farm. 2. Environmental Regulation It will be ensured that ventilation control systems are in optimum working order so as to keep the temperature and humidity in the houses at the required levels. 3. Animal Carcass Storage It will be ensured that all animal tissue wastes on site, are stored and disposed of as required. All such material is collected, stored and disposed of in line with licence requirements. 4. Slurry Storage/Removal It will be ensured that the amount of movement of slurry around the site is minimized where possible, and that agitation of slurry is avoided, so as to avoid any unnecessary odour emissions. NO unnecessary agitation/mixing of manure is carried out. 5. Soiled Yards/Dirty Areas All external areas, other than slatted passageways, that pigs are traversed across between houses, or areas where pigs are held prior to loading for transport off site, will be washed as soon as possible after these jobs have been completed. This will avoid the build up of potential odour causing material in these areas. Please refer to response to point No. 1. Leddy B.Agr.Sc., P. Fay B.Agr.Sc. V.A.T. Reg. No. 8277204J 6. Stockmanship One of the most important roles on any pig farm relates to the care and management of the pigs, i.e. stockmanship. It is important that all pigs are kept in optimum conditions in so far as the temperature, humidity, stocking rates, availability of fresh feed and water and many other factors are concerned. If these requirements are not met the pigs may become unsettled and particularly in solid or partially slatted floors this may lead to dirty pigs which will increase odour emissions from that pig/pen/house, as the pigs body heat will accelerate the rate of release of odour. It is essential that these situations are not allowed to arise. This area is strongly linked with point no. 2 as already described. 7. Use of Low protein Diets All of the diets fed to the pigs on this farm should be formulated to minimize odour, nutrient and manure production while at the same time maximizing animal performance. The use of low- protein diets will continue to be implemented on site. 8.
