Previous Ref.No’s. 20/48. Applicant: Rachael McCabe Proposed Development: Planning permission consists of the change of use and alteration of existing domestic garage, to provide a music school within the existing garage which will include a waiting area, a main teaching room, 2 private teaching rooms, accessible W/C and storage areas. Site works including new car parking area, connection to existing services and all ancillary works Location: Killycoonagh, Newbliss, Co.Monaghan, H18FD35 Adjoining Road: R-183-5 Notice on site: Yes Engineer’s Reports Assessment of Further Information Further Information was requested seeking the submission of a revised site layout plan demonstrating that visibility splays of 120 metres are achievable in both directions at the proposed site entrance onto the R-183-5. The revised site layout plan submitted indicates 120-metre visibility splays in both directions from the proposed access. However, notwithstanding the visibility splays shown on the submitted drawings, it is evident from site conditions that the required visibility is not achievable in practice. An overgrown hedgerow located on adjoining third-party lands obstructs sightlines at the proposed entrance and materially restricts visibility along the public road. As these lands are outside the applicant's ownership or control, the Planning Authority cannot be satisfied that the required sight distance can be provided or maintained on a permanent basis. Furthermore, while legal agreements from adjoining landowners were specifically requested to facilitate any works necessary to establish and maintain the required visibility splays, no such agreements or supporting documentation have been submitted as part of the application. Accordingly, it has not been demonstrated that the applicant has the legal ability to carry out or maintain the works required to achieve the prescribed sightlines.
